Bu maddeye g\u00f6re, kiraya veren, kiralanan\u0131n yeniden in\u015fas\u0131, imar\u0131, esasl\u0131 onar\u0131m\u0131, geni\u015fletilmesi veya de\u011fi\u015ftirilmesi gerekti\u011finde ve bu i\u015fler s\u0131ras\u0131nda kiralanan\u0131n kullan\u0131m\u0131n\u0131n imkans\u0131z oldu\u011fu durumlarda, belirli s\u00fcreli kira s\u00f6zle\u015fmelerinde s\u00f6zle\u015fme s\u00fcresinin sonunda, belirsiz s\u00fcreli kira s\u00f6zle\u015fmelerinde ise fesih d\u00f6nemi ve bildirim s\u00fcrelerine uyularak bir ay i\u00e7inde dava a\u00e7arak kirac\u0131y\u0131 tahliye edebilir.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"aioseo-kiralananin-yikilip-yeniden-insasi\">Kiralanan\u0131n Y\u0131k\u0131l\u0131p Yeniden \u0130n\u015fas\u0131<\/h3>\n\n\n\n<p>\u0130n\u015faat veya Tadilat Nedeniyle Kirac\u0131n\u0131n Tahliyesi i\u00e7in \u00f6ncelikle kiralanan\u0131n y\u0131k\u0131l\u0131p yerine yeni bir bina in\u015fa edilmesi gerekmektedir. Bina y\u0131k\u0131lacaksa kirac\u0131 zaten ta\u015f\u0131nmaz\u0131 kullanamayaca\u011f\u0131 i\u00e7in bu \u015fart aranmaz.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"aioseo-imar-tadilat-amacli-esasli-onarim-genisletme-ve-degistirme\">\u0130mar (Tadilat) Ama\u00e7l\u0131 Esasl\u0131 Onar\u0131m, Geni\u015fletme ve De\u011fi\u015ftirme<\/h3>\n\n\n\n<p>Kiraya veren, kiralanan\u0131 imar ama\u00e7l\u0131 tadilat, geni\u015fletme veya de\u011fi\u015ftirme \u00e7al\u0131\u015fmalar\u0131 yaparak kullan\u0131labilir duruma getirmek istiyorsa, bu i\u015flemlerin esasl\u0131 olmas\u0131 gerekmektedir. \u00d6rne\u011fin, binan\u0131n zamanla hasar g\u00f6rmesi veya eskimesi durumunda yap\u0131lacak onar\u0131mlar esasl\u0131 tadilat kapsam\u0131na girebilir.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"aioseo-kiralananin-kullaniminin-imkansiz-hale-gelmesi\">Kiralanan\u0131n Kullan\u0131m\u0131n\u0131n \u0130mkans\u0131z Hale Gelmesi<\/h3>\n\n\n\n<p>\u0130mar veya tadilat \u00e7al\u0131\u015fmalar\u0131 s\u0131ras\u0131nda kiralanan\u0131n kullan\u0131m\u0131n\u0131n imkans\u0131z hale gelmesi gerekmektedir. Bu projenin belediye taraf\u0131ndan onaylanm\u0131\u015f olmas\u0131 gerekmektedir.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"aioseo-sure\">\u0130n\u015faat veya Tadilat Nedeniyle Kirac\u0131n\u0131n Tahliyesi S\u00fcresi<\/h3>\n\n\n\n<p>Kiraya veren, tahliye davas\u0131n\u0131 belirli s\u00fcreli kira s\u00f6zle\u015fmelerinin s\u00fcresinin sonunda veya belirsiz s\u00fcreli kira s\u00f6zle\u015fmelerinde fesih d\u00f6nemi ve bildirim s\u00fcrelerine uyarak bir ay i\u00e7inde a\u00e7mal\u0131d\u0131r.<\/p>\n\n\n\n<p>Yeniden in\u015fa nedeniyle tahliye davas\u0131nda, g\u00f6revli mahkeme Sulh Hukuk Mahkemesi olup, yetkili mahkeme ta\u015f\u0131nmaz\u0131n bulundu\u011fu yerdeki Sulh Hukuk Mahkemesidir. M\u00fcvekkillerimizin gayrimenkul i\u015flemlerinin her a\u015famas\u0131nda yanlar\u0131nda yer alarak, yasal s\u00fcre\u00e7lerde destek sa\u011fl\u0131yor ve haklar\u0131n\u0131 korumak i\u00e7in gereken ad\u0131mlar\u0131 at\u0131yoruz. \u0130mar mevzuat\u0131na uyum konusunda dan\u0131\u015fmanl\u0131k yaparak, projelerin yasal gerekliliklere uygunlu\u011funu sa\u011fl\u0131yoruz.
