T\u00fcrk Bor\u00e7lar Kanunu&#8217;nun 352. Maddesi, kirac\u0131n\u0131n kira bedelini zaman\u0131nda \u00f6dememesi veya eksik \u00f6demesi durumunda kiraya verenin h\u0131zl\u0131 ve etkili bir \u00e7\u00f6z\u00fcm olarak iki hakl\u0131 ihtar yoluyla tahliye hakk\u0131n\u0131 d\u00fczenlemektedir. Bu mekanizma, k\u0131sa s\u00fcreli ve uzun s\u00fcreli kira s\u00f6zle\u015fmeleri i\u00e7in farkl\u0131 s\u00fcre\u00e7ler i\u00e7ermektedir.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"aioseo-iki-hakli-ihtar-nedeniyle-tahliye-davasi-kosullar-ve-surec\">\u0130ki Hakl\u0131 \u0130htar Nedeniyle Tahliye Davas\u0131: Ko\u015fullar ve S\u00fcre\u00e7<\/h3>\n\n\n\n<p>\u0130ki hakl\u0131 ihtar nedeniyle tahliye davas\u0131, belirli ko\u015fullar\u0131n sa\u011flanmas\u0131 ve belirlenen s\u00fcrelerin takip edilmesiyle ger\u00e7ekle\u015fir. Bu ko\u015fullar \u015funlard\u0131r:<\/p>\n\n\n\n<p><strong>Kira Borcunun Tam ve Zaman\u0131nda \u00d6denmemesi:<\/strong> Kirac\u0131n\u0131n, kira s\u00f6zle\u015fmesinde belirtilen s\u00fcrelerde kira bedelini \u00f6dememesi veya eksik \u00f6demesi durumunda, kiraya verenin iki hakl\u0131 ihtar hakk\u0131 do\u011far.<\/p>\n\n\n\n<p><strong>\u0130htar\u0131n Yaz\u0131l\u0131 Olmas\u0131:<\/strong> \u0130ki hakl\u0131 ihtar\u0131n ge\u00e7erli olabilmesi i\u00e7in yaz\u0131l\u0131 olarak yap\u0131lmas\u0131 gerekir. \u0130htar, noter arac\u0131l\u0131\u011f\u0131yla, posta yoluyla veya di\u011fer yaz\u0131l\u0131 ileti\u015fim ara\u00e7lar\u0131yla ger\u00e7ekle\u015ftirilebilir.<\/p>\n\n\n\n<p><strong>\u0130ki Farkl\u0131 Kira Ay\u0131na \u0130li\u015fkin \u0130htar:<\/strong> \u0130ki hakl\u0131 ihtar, farkl\u0131 kira d\u00f6nemlerine ili\u015fkin olmal\u0131d\u0131r. \u00d6rne\u011fin, bir kira d\u00f6neminde \u00f6denmeyen kira bedeli i\u00e7in bir ihtar, bir sonraki kira d\u00f6neminde \u00f6denmeyen kira bedeli i\u00e7in di\u011fer bir ihtar \u00e7ekilmelidir.<\/p>\n\n\n\n<p><strong>\u0130ki Hakl\u0131 \u0130htar\u0131n Ayn\u0131 Kira D\u00f6nemine \u0130li\u015fkin Olmas\u0131:<\/strong> \u0130ki hakl\u0131 ihtar, ayn\u0131 kira d\u00f6nemine ili\u015fkin olmal\u0131d\u0131r. Bu, k\u0131sa s\u00fcreli veya uzun s\u00fcreli kira s\u00f6zle\u015fmelerine g\u00f6re de\u011fi\u015fkenlik g\u00f6sterir.<\/p>\n\n\n\n<p><strong>Bir Ayl\u0131k S\u00fcre \u0130\u00e7inde Davan\u0131n A\u00e7\u0131lmas\u0131:<\/strong> \u0130ki hakl\u0131 ihtar sonras\u0131nda tahliye davas\u0131, bir ayl\u0131k hak d\u00fc\u015f\u00fcr\u00fcc\u00fc s\u00fcre i\u00e7inde a\u00e7\u0131lmal\u0131d\u0131r. Ancak, icra takibi yoluyla tahliye talebi, kirac\u0131n\u0131n \u00f6deme yapmas\u0131 durumunda ge\u00e7ersiz hale gelir. Bu nedenle, \u00f6deme emri gibi yaz\u0131l\u0131 belgeler, iki hakl\u0131 ihtar\u0131n yerine ge\u00e7erek tahliye davas\u0131n\u0131n a\u00e7\u0131lmas\u0131 i\u00e7in yeterli kabul edilir.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"aioseo-zamanasimi-ve-yetkili-mahkeme\">Zamana\u015f\u0131m\u0131 ve Yetkili Mahkeme<\/h3>\n\n\n\n<p>Kiras\u0131n\u0131 \u00d6demeyen Kirac\u0131n\u0131n \u0130ki Hakl\u0131 \u0130htarla Tahliyesi, belirlenen s\u00fcreler i\u00e7inde a\u00e7\u0131lmal\u0131d\u0131r ve bu s\u00fcre\u00e7te g\u00f6revli mahkeme Sulh Hukuk Mahkemesi&#8217;dir. Ayr\u0131ca, kirac\u0131n\u0131n tahliyesi i\u00e7in bu s\u00fcrecin zamana\u015f\u0131m\u0131na u\u011framamas\u0131 \u00f6nemlidir.<\/p>\n\n\n\n<p>\u0130ki hakl\u0131 ihtar nedeniyle tahliye davas\u0131, kiraya verenin kira bedelinin zaman\u0131nda ve tam olarak \u00f6denmemesi durumunda ba\u015fvurabilece\u011fi h\u0131zl\u0131 ve etkili bir \u00e7\u00f6z\u00fcm yoludur.
