Kirac\u0131n\u0131n temel borcu, kira bedelini \u00f6demesidir. Ancak kira bedeli \u00f6denmezse, kiraya verenin tahliye talebinde bulunabilece\u011fi \u00e7e\u015fitli yollar vard\u0131r.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"aioseo-a-temerrut-sebebi-ile-tahliye-davasinin-ikame-edilmesi\">Temerr\u00fct Sebebi ile Tahliye Davas\u0131 A\u00e7\u0131lmas\u0131<\/h3>\n\n\n\n<p><a href=\"https:\/\/www.mevzuat.gov.tr\/mevzuatmetin\/1.5.6098.pdf\" title=\"\">T\u00fcrk Bor\u00e7lar Kanunu<\/a>&#8216;nun 315. maddesine g\u00f6re, kirac\u0131n\u0131n kira bedelini veya yan giderleri \u00f6dememesi durumunda kiraya veren yaz\u0131l\u0131 olarak kirac\u0131ya s\u00fcre vererek borcun \u00f6denmesini isteyebilir. Bu s\u00fcre en az 30 g\u00fcn (\u00e7at\u0131l\u0131 i\u015fyerleri i\u00e7in) veya 10 g\u00fcn (di\u011fer kira s\u00f6zle\u015fmeleri i\u00e7in) olmal\u0131d\u0131r. Kirac\u0131 s\u00fcresinde \u00f6deme yapmazsa, kiraya veren tahliye davas\u0131 a\u00e7abilir.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"aioseo-b-iki-hakli-ihtar-cekilmesi-ve-akabinde-tahliye-davasi-acilmasiyla-kiracinin-tahliyesi\">\u0130ki Hakl\u0131 \u0130htar \u00c7ekilmesi ve Akabinde Tahliye Davas\u0131 A\u00e7\u0131lmas\u0131<\/h3>\n\n\n\n<p>TBK&#8217;n\u0131n 352. maddesine g\u00f6re, kirac\u0131 bir kira y\u0131l\u0131 i\u00e7inde iki hakl\u0131 ihtara maruz kal\u0131rsa, kiraya veren tahliye davas\u0131 a\u00e7abilir. \u0130htarlarla birlikte, kiraya verenin ta\u015f\u0131nmaz\u0131n bulundu\u011fu yer Sulh Hukuk Mahkemesi&#8217;ne ba\u015fvurmas\u0131 gerekmektedir. Kirac\u0131, \u00f6deme emrini ald\u0131ktan sonra 7 g\u00fcn i\u00e7inde itiraz etmelidir. E\u011fer kirac\u0131 itiraz etmez ve 30 g\u00fcn i\u00e7inde borcunu \u00f6demezse, ta\u015f\u0131nmaz icra m\u00fcd\u00fcrl\u00fc\u011f\u00fc arac\u0131l\u0131\u011f\u0131yla tahliye edilebilir.<\/p>\n\n\n\n<p>Bu y\u00f6ntemler, kira bedelinin \u00f6denmemesi durumunda kiraya verenin takip edebilece\u011fi yasal yollar\u0131 temsil etmektedir.
