nitelendirilen yap\u0131lar hakk\u0131nda her t\u00fcrl\u00fc d\u00fczenlemelerin bulundu\u011fu ve taraflar aras\u0131nda \u00e7\u0131kan uyu\u015fmazl\u0131klara \u00e7\u00f6z\u00fcmlerin \u00fcretildi\u011fi hukuk dal\u0131na&nbsp;<strong>Gayrimenkul Hukuku<\/strong>&nbsp;denmektedir. T\u00fcrk Hukuku\u2019nda Gayrimenkul Hukuku\u2019na ili\u015fkin d\u00fczenlemeler&nbsp;<strong><a href=\"http:\/\/www.mevzuat.gov.tr\/Metin.Aspx?MevzuatKod=1.5.4721&amp;MevzuatIliski=0&amp;sourceXmlSearch\">4721 say\u0131l\u0131 T\u00fcrk Medeni Kanunu<\/a><\/strong>\u2019nun ta\u015f\u0131nmazlara ili\u015fkin h\u00fck\u00fcmlerin bulundu\u011fu 4. kitab\u0131nda yer almaktad\u0131r.<\/p>\n\n\n\n<p><strong>Gayrimenkul hukuku<\/strong>&nbsp;\u00e7ok geni\u015f kapsaml\u0131 bir hukuk dal\u0131d\u0131r. Genel olarak; gayrimenkul al\u0131m ve sat\u0131m s\u00f6zle\u015fmesi, kira s\u00f6zle\u015fmesi, kat irtifak\u0131 s\u00f6zle\u015fmesi, in\u015faat s\u00f6zle\u015fmesi, bina y\u00f6netimi ve site y\u00f6netimi s\u00f6zle\u015fmesi, proje y\u00f6netimi s\u00f6zle\u015fmesi, arsa pay\u0131 kar\u015f\u0131l\u0131\u011f\u0131 in\u015faat s\u00f6zle\u015fmesi\u2026 gibi pek \u00e7ok s\u00f6zle\u015fmenin d\u00fczenlenmesini, gayrimenkullerin sat\u0131\u015f s\u00fcrecinin y\u00fcr\u00fct\u00fclmesini, yat\u0131r\u0131m ortakl\u0131klar\u0131na ili\u015fkin i\u015flemlerin yap\u0131lmas\u0131n\u0131 kapsamaktad\u0131r. Bu davada h\u00e2kim \u00f6ncelikli olarak ta\u015f\u0131nmaz\u0131n aynen taksimi suretiyle ortakl\u0131\u011f\u0131n giderilmesini sa\u011flamaya \u00e7al\u0131\u015facak, bunun m\u00fcmk\u00fcn olmamas\u0131 durumunda da ortakl\u0131\u011f\u0131n sat\u0131\u015f sureti ile giderilmesini h\u00fck\u00fcm alt\u0131na alacakt\u0131r.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"aioseo-tapu-iptal-ve-tescil-davasi\"><strong><a href=\"https:\/\/turkeylegal.com.tr\/tr\/tapu-iptal-ve-tescil-davasi-avukati\">Tapu \u0130ptal ve Tescil Davas\u0131<\/a><\/strong><\/h3>\n\n\n\n<p>Kanuna ayk\u0131r\u0131 olarak; usuls\u00fcz veya hatal\u0131 bir \u015fekilde yap\u0131ld\u0131\u011f\u0131 iddia edilen tapu kay\u0131tlar\u0131n\u0131n d\u00fczeltilmesi i\u00e7in a\u00e7\u0131lan dava t\u00fcr\u00fcne denmektedir. Bu dava genellikle; tapu kayd\u0131n\u0131n yap\u0131ld\u0131\u011f\u0131 anda hukuki ehliyetin bulunmamas\u0131, muris muvazas\u0131 (mirastan mal ka\u00e7\u0131rma) durumunun bulunmas\u0131, ta\u015f\u0131nmaz\u0131n aile konutu olmas\u0131\u2026 gibi sebepler nedeniyle a\u00e7\u0131lmaktad\u0131r.<\/p>\n\n\n\n<p>T\u00fcrk Medeni Kanunu\u2019nun 1024. Maddesi gere\u011fince bir ayni hak yolsuz olarak tescil edilmi\u015f ise, s\u00f6z konusu ayni hak sahibinin bu tescili korunamayacakt\u0131r. Ba\u011flay\u0131c\u0131 olmayan bir hukuk\u00ee i\u015fleme dayanan veya hukuk\u00ee sebepten yoksun bulunan tescil yolsuzdur. B\u00f6yle bir tescil y\u00fcz\u00fcnden ayni hakk\u0131 zedelenen kimse bu yolsuz tescili iyi niyetli olmayan 3. Ki\u015fileri tapu sicilinin d\u00fczeltilmesi amac\u0131yla dava edebilir.<\/p>\n\n\n\n<p>T\u00fcrk Medeni Kanunu\u2019na g\u00f6re ta\u015f\u0131nmaz m\u00fclkiyeti kural olarak ge\u00e7erli ve hukuka uygun bir hukuki i\u015fleme dayal\u0131 ve tapu k\u00fct\u00fc\u011f\u00fcnde yap\u0131lacak tescil ile kazan\u0131lmakta ise de kanun koyucu taraf\u0131ndan bir tak\u0131m \u015fartlara ba\u011fl\u0131 olarak istisnai yollarla ta\u015f\u0131nmaz iktisab\u0131 m\u00fcmk\u00fcn k\u0131l\u0131nm\u0131\u015ft\u0131r.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"aioseo-olagan-zamanasimi-ile-kazanim\">Ola\u011fan Zamana\u015f\u0131m\u0131 \u0130le Kazan\u0131m<\/h3>\n\n\n\n<p>Ola\u011fan zamana\u015f\u0131m\u0131 ile kazan\u0131m ise bu yollardan biridir. Ge\u00e7erli bir hukuk\u00ee sebep olmaks\u0131z\u0131n tapu k\u00fct\u00fc\u011f\u00fcne malik olarak yaz\u0131lan ki\u015fi, ta\u015f\u0131nmaz \u00fczerindeki zilyetli\u011fini davas\u0131z ve aral\u0131ks\u0131z olarak on y\u0131l s\u00fcreyle ve iyi niyetle s\u00fcrd\u00fcr\u00fcrse, onun bu yolla kazanm\u0131\u015f oldu\u011fu m\u00fclkiyet hakk\u0131na itiraz edilemez.<\/p>\n\n\n\n<p>Ola\u011fan zamana\u015f\u0131m\u0131 ile kazan\u0131m\u0131n \u015fartlar\u0131n\u0131 belirtmek gerekir ise; 1- Tapuya kay\u0131tl\u0131 bir ta\u015f\u0131nmaz\u0131n bulunmas\u0131 gerekmektedir. Zira i\u015fbu iktisap \u015feklinin temelinde tapuya kay\u0131t i\u015flemi yatmakta olup tapu k\u00fct\u00fc\u011f\u00fcnde kay\u0131tl\u0131 olmayan ta\u015f\u0131nmazlar\u0131n ola\u011fan zamana\u015f\u0131m\u0131 ile iktisab\u0131 m\u00fcmk\u00fcn de\u011fildir. 2- Ge\u00e7erli bir hukuki sebebe dayanmayan tescil. 3- Tapuda yap\u0131lan yolsuz tescilin aral\u0131ks\u0131z ve davas\u0131z 10 y\u0131l s\u00fcrmesi gerekmektedir. Ge\u00e7erli bir sebebe dayanmaks\u0131z\u0131n tapuda malik olarak kaydedilen ki\u015finin, bu ta\u015f\u0131nmaz \u00fczerindeki zilyetli\u011fini 10 y\u0131l boyunda aral\u0131ks\u0131z ve davas\u0131z olarak s\u00fcrd\u00fcrmesi gerekmektedir. 4- Malik s\u0131fat\u0131yla zilyetli\u011fin iyi niyetli olarak s\u00fcrd\u00fcr\u00fclmesi gerekmektedir.<\/p>\n\n\n\n<p>Yukar\u0131da ifade edilen her bir \u015fart, ola\u011fan zamana\u015f\u0131m\u0131 ile iktisab\u0131n zaruri unsuru olup \u015fartlardan birinin somut olayda bulunmamas\u0131 ola\u011fan zamana\u015f\u0131m\u0131 ile iktisaba engel te\u015fkil edecektir.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"aioseo-olaganustu-zamanasimi-ile-iktisap\">Ola\u011fan\u00fcst\u00fc Zamana\u015f\u0131m\u0131 \u0130le \u0130ktisap<\/h3>\n\n\n\n<p>Zamana\u015f\u0131m\u0131 ile kazan\u0131m yollar\u0131ndan bir di\u011feri ise ola\u011fan\u00fcst\u00fc zamana\u015f\u0131m\u0131d\u0131r. Tapu k\u00fct\u00fc\u011f\u00fcnde kay\u0131tl\u0131 olmayan bir ta\u015f\u0131nmaz\u0131 davas\u0131z ve aral\u0131ks\u0131z olarak yirmi y\u0131l s\u00fcreyle ve malik s\u0131fat\u0131yla zilyetli\u011finde bulunduran ki\u015fi, o ta\u015f\u0131nmaz\u0131n tamam\u0131, bir par\u00e7as\u0131 veya bir pay\u0131 \u00fczerindeki m\u00fclkiyet hakk\u0131n\u0131n tapu k\u00fct\u00fc\u011f\u00fcne tesciline karar verilmesini isteyebilir.<\/p>\n\n\n\n<p>Ayn\u0131 ko\u015fullar alt\u0131nda, maliki tapu k\u00fct\u00fc\u011f\u00fcnden anla\u015f\u0131lamayan veya yirmi y\u0131l \u00f6nce hakk\u0131nda gaiplik karar\u0131 verilmi\u015f bir kimse ad\u0131na kay\u0131tl\u0131 bulunan ta\u015f\u0131nmaz\u0131n tamam\u0131n\u0131n veya b\u00f6l\u00fcnmesinde sak\u0131nca olmayan bir par\u00e7as\u0131n\u0131n zilyedi de, o ta\u015f\u0131nmaz\u0131n tamam\u0131, bir par\u00e7as\u0131 veya bir pay\u0131 \u00fczerindeki m\u00fclkiyet hakk\u0131n\u0131n tapu k\u00fct\u00fc\u011f\u00fcne tesciline karar verilmesini isteyebilir.<\/p>\n\n\n\n<p>Kanun d\u00fczenlemesi incelendi\u011fi takdirde ola\u011fan\u00fcst\u00fc zamana\u015f\u0131m\u0131 yoluyla kazan\u0131m i\u00e7in g\u00f6r\u00fclecektir ki; tapu sicilinde malikin kim oldu\u011funun bilinmesine yarayacak, kimli\u011fini ortaya koyacak gerekli bilgi ve belgelerin tapu sicilinden \u00e7\u0131kar\u0131lmas\u0131n\u0131n imkans\u0131z olmas\u0131 gerekmektedir. Bu durumlara \u00f6rnek vermek gerekirse; tapu k\u00fct\u00fc\u011f\u00fcnde malik s\u00fctununun bo\u015f b\u0131rak\u0131lmas\u0131, silinmesi ve yeniden yaz\u0131lmamas\u0131, soyut ve nam-\u0131 mevhum ad\u0131na (mevcut olmayan hayali ki\u015fi) yaz\u0131lmas\u0131, hi\u00e7 ya\u015famam\u0131\u015f ve kayd\u0131n\u0131n herhangi bir yerde bulunmam\u0131\u015f olmas\u0131, malik ad\u0131n\u0131n m\u00fcphem, yetersiz ve soyut g\u00f6sterilmi\u015f olmas\u0131 gibi durumlarda malikin kim oldu\u011funun anla\u015f\u0131lamad\u0131\u011f\u0131 kabul edilir. Arsa paylar\u0131, ki\u015filerin sahip olduklar\u0131 ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerin paylar\u0131 ile orant\u0131l\u0131 olarak tahsis edilmedi\u011fi hallerde, her kat sahibi arsa pay\u0131n\u0131n d\u00fczenlenmesi i\u00e7in bu davay\u0131 a\u00e7abilecektir.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"aioseo-kira-bedelinin-tespiti-davalari\"><strong><a href=\"https:\/\/turkeylegal.com.tr\/tr\/Kira-Tespit-Davasi-Avukati\">Kira Bedelinin Tespiti Davalar\u0131<\/a><\/strong><\/h3>\n\n\n\n<p>Kira s\u00f6zle\u015fmeleri; kirac\u0131 ile kiraya veren aras\u0131nda kar\u015f\u0131l\u0131kl\u0131 irade beyan\u0131na dayal\u0131 olarak yap\u0131lan s\u00f6zle\u015fmelerdir. Bu s\u00f6zle\u015fmelerin yap\u0131labilmesi i\u00e7in taraflar\u0131n kira bedelinin belirlenmesi noktas\u0131nda kar\u015f\u0131l\u0131kl\u0131 muvafakate varm\u0131\u015f olmalar\u0131 gerekmektedir. G\u00fcn\u00fcm\u00fczde ta\u015f\u0131nmaz sahipleri kira s\u00f6zle\u015fmesinin yenilenmesi durumunda mevcut kiraya belirli oranlarda zam yapmaktad\u0131rlar. \u0130\u015fte kira bedelinin belirlenmesi a\u015famas\u0131nda taraflar aras\u0131nda uyu\u015fmazl\u0131k \u00e7\u0131kmas\u0131 durumunda, bedelin; hakim taraf\u0131ndan emsal kira bedellerine ve hakkaniyete uygun \u015fekilde belirlenmesi i\u00e7in a\u00e7\u0131lan davaya Kira Bedelinin Tespiti Davas\u0131 denir.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"aioseo-kiracinin-tahliyesi-davalari\"><strong><a href=\"https:\/\/turkeylegal.com.tr\/tr\/Ihtiyac-Nedeniyle-Kiracinin-Tahliyesi\">Kirac\u0131n\u0131n Tahliyesi Davalar\u0131<\/a><\/strong><\/h3>\n\n\n\n<p>Bir ta\u015f\u0131nmazdaki kirac\u0131n\u0131n tahliyesinin istenmesi durumunda kiraya veren bunu iki \u015fekilde ger\u00e7ekle\u015ftirebilmektedir. Bunlar: bildirim yolu ve tahliye davas\u0131 a\u00e7ma yoludur. Tahliye davas\u0131, kira s\u00f6zle\u015fmesinin mahkeme karar\u0131 ile sonland\u0131r\u0131lmas\u0131na y\u00f6nelik olarak a\u00e7\u0131lan bir dava t\u00fcr\u00fcd\u00fcr. Bu davan\u0131n a\u00e7\u0131labilmesini kanun koyucu \u00e7e\u015fitli sebeplerin varl\u0131\u011f\u0131na ba\u011flam\u0131\u015ft\u0131r. Bu sebeplerden baz\u0131lar\u0131 kiraya verenden kaynaklanmaktayken (kiraya verenin ihtiyac\u0131, yeni malikin ihtiyac\u0131\u2026), baz\u0131lar\u0131 kirac\u0131dan kaynaklanmaktad\u0131r (hakl\u0131 sebeple kirac\u0131ya verilen 2 ihtar nedeni ile, kirac\u0131n\u0131n kendi konutunun bulunmas\u0131 nedeni ile). Ayn\u0131 \u015fekilde m\u00fcteahhit de s\u00f6zle\u015fmede ve s\u00f6zle\u015fme ekindeki teknik \u015fartnamede \u00f6ng\u00f6r\u00fclen yap\u0131y\u0131 tam ve eksiksiz, kusursuz, ay\u0131ps\u0131z olarak s\u00fcresi i\u00e7erisinde yap\u0131p teslim etmek zorundad\u0131r. Ancak bu noktada uygulamada maalesef ki \u00e7e\u015fitli s\u0131k\u0131nt\u0131larla kar\u015f\u0131la\u015f\u0131lmaktad\u0131r. Bu s\u0131k\u0131nt\u0131lara kar\u015f\u0131 da kanun koyucu koruyucu h\u00fck\u00fcmler getirerek do\u011fmu\u015f veya do\u011fabilecek zararlar\u0131 \u00f6nlemeye \u00e7al\u0131\u015fm\u0131\u015ft\u0131r. \u00d6rne\u011fin; m\u00fcteahhidin gayrimenkul\u00fc ge\u00e7 teslim etmesi durumunda arsa maliki m\u00fcteahhitten kira tazminat\u0131 isteyebilecektir veya binan\u0131n ay\u0131pl\u0131 \u015fekilde teslim edilmesi durumunda tazminat davas\u0131n\u0131n a\u00e7\u0131lmas\u0131 imk\u00e2n\u0131 getirilmi\u015ftir. Yine ayn\u0131 \u015fekilde binan\u0131n eksik bir \u015fekilde teslim edilmesi durumunda eksik teslim tazminat\u0131 istenebilecektir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"aioseo-gayrimenkul-hukukundan-dogan-davalarda-yetki\">Gayrimenkul Hukukundan Do\u011fan Davalarda Yetki<\/h2>\n\n\n\n<p>Gayrimenkul hukukundan do\u011fan davalarda, davan\u0131n a\u00e7\u0131laca\u011f\u0131 mahkemenin belirlenmesinde&nbsp;<strong><a href=\"http:\/\/www.mevzuat.gov.tr\/MevzuatMetin\/1.5.6100.pdf\">6100 say\u0131l\u0131 T\u00fcrk Hukuk Muhakemeleri Kanunu<\/a><\/strong>&nbsp;\u00f6zel ve kesin bir yetki \u015fart\u0131 getirmi\u015ftir. Buna g\u00f6re ta\u015f\u0131nmaz\u0131n ayn\u0131ndan do\u011fan davalar\u0131n ta\u015f\u0131nmaz\u0131n bulundu\u011fu yer mahkemesinde a\u00e7\u0131lmas\u0131 gerekmektedir.
