Ancak bu durumun istisnalar\u0131 mevcuttur. Bunlardan biri de 15 y\u0131l sigortal\u0131l\u0131k ve 3600 g\u00fcn prim \u00f6deme durumudur.<\/p>\n\n\n\n<p>Bu ihtimalde i\u015f\u00e7i, hi\u00e7bir hakl\u0131 nedeni bulunmasa dahi, kendi iste\u011fi ile i\u015finden ayr\u0131lmas\u0131 durumunda k\u0131dem tazminat\u0131n\u0131 almaya hak kazanacakt\u0131r. Ancak bunun i\u00e7in birtak\u0131m \u015fartlar\u0131n daha ger\u00e7ekle\u015fmesi gerekir.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"683\" src=\"https:\/\/turkeylegal.com.tr\/tr\/wp-content\/uploads\/2024\/06\/15-Yil-3600-Gun-Ile-Kidem-Tazminati-Alma-1024x683.jpg\" alt=\"3600 G\u00fcn \u0130le K\u0131dem Tazminat\u0131\" class=\"wp-image-24865\" srcset=\"https:\/\/turkeylegal.com.tr\/tr\/wp-content\/uploads\/2024\/06\/15-Yil-3600-Gun-Ile-Kidem-Tazminati-Alma-1024x683.jpg 1024w, https:\/\/turkeylegal.com.tr\/tr\/wp-content\/uploads\/2024\/06\/15-Yil-3600-Gun-Ile-Kidem-Tazminati-Alma-300x200.jpg 300w, https:\/\/turkeylegal.com.tr\/tr\/wp-content\/uploads\/2024\/06\/15-Yil-3600-Gun-Ile-Kidem-Tazminati-Alma-768x512.jpg 768w, https:\/\/turkeylegal.com.tr\/tr\/wp-content\/uploads\/2024\/06\/15-Yil-3600-Gun-Ile-Kidem-Tazminati-Alma.jpg 1199w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<p>Bu \u015fartlardan ilki ve en \u00f6nemlisi, <strong>i\u015f\u00e7inin sigortal\u0131l\u0131\u011f\u0131n\u0131n 08.09.1999 tarihinden \u00f6nceye dayanmas\u0131d\u0131r.<\/strong> Bu tarihten sonra sigortal\u0131l\u0131\u011f\u0131 ba\u015flayanlar, bu kapsamda olmayacaklard\u0131r.<\/p>\n\n\n\n<p>Di\u011fer bir \u015fart olarak <strong>i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131\u011f\u0131 i\u015fyerinde en az bir y\u0131l \u00e7al\u0131\u015f\u0131yor olmal\u0131d\u0131r.<\/strong> Son \u015fart ise yukar\u0131da a\u00e7\u0131k\u00e7a belirtildi\u011fi \u00fczere prim \u00f6deme g\u00fcn say\u0131s\u0131 3600 g\u00fcnden fazla olmal\u0131, sigortal\u0131l\u0131k s\u00fcresi ise 15 y\u0131l\u0131 ge\u00e7melidir. <span style=\"text-decoration: underline;\">15 y\u0131l ve 3600 g\u00fcn<\/span> \u015fart\u0131n\u0131n ayn\u0131 i\u015fveren yan\u0131nda ger\u00e7ekle\u015fmesi gerekmez. Di\u011fer bir anlat\u0131mla bu \u015fartlar, farkl\u0131 i\u015fyerlerinde tamamlanabilir.<\/p>\n\n\n\n<p>\u0130\u015f\u00e7ilerin yararland\u0131\u011f\u0131 bu hakk\u0131n sebebi, 1475 say\u0131l\u0131 \u0130\u015f Kanunu\u2019nun 14. maddesinin 5. f\u0131kras\u0131d\u0131r. Bu hakk\u0131n\u0131 kullanmak isteyen i\u015f\u00e7i, \u00f6ncelikle ilgili SGK\u2019dan durumun tespitine y\u00f6nelik belge almal\u0131d\u0131r.<\/p>\n\n\n\n<p>SGK taraf\u0131ndan verilen yaz\u0131da i\u015f\u00e7inin 1475 say\u0131l\u0131 \u0130\u015f Kanunu\u2019nun 14\/5 h\u00fckm\u00fcne istinaden verildi\u011fi belirtilmektedir. \u0130\u015f\u00e7i bu yaz\u0131 ile i\u015fverenine ba\u015fvurmal\u0131, SGK taraf\u0131ndan verilen yaz\u0131y\u0131 da yaz\u0131l\u0131 talebine eklemelidir.<\/p>\n\n\n\n<p>G\u00fcn\u00fcm\u00fczde hal b\u00f6yle iken yine de uyu\u015fmazl\u0131klar ortaya \u00e7\u0131kabilmekte, baz\u0131 i\u015f\u00e7iler haklar\u0131n\u0131 alamamaktad\u0131r. \u0130\u015fveren i\u015f\u00e7inin hareketini keyfi bulsa da Yarg\u0131tay kararlar\u0131na g\u00f6re de i\u015f\u00e7inin herhangi bir hakl\u0131 nedeni bulunmasa dahi bu tazminat\u0131 alabilece\u011fi kabul edilmi\u015ftir.<\/p>\n\n\n\n<p>Hatta ayr\u0131ld\u0131ktan hemen sonra yeni bir i\u015fe ba\u015flanmas\u0131 durumunda dahi durum b\u00f6yledir.
