Malik s\u0131fat\u0131n\u0131n tapu kayd\u0131 ile ispatlanmas\u0131 gerekir.<\/li>\n\n\n\n<li><strong>Tahliye Talebi:<\/strong> Yeni malik, ta\u015f\u0131nmaz\u0131 kendisi veya birinci derece yak\u0131nlar\u0131 i\u00e7in konut veya i\u015fyeri olarak kullanmak amac\u0131yla tahliye talep etmelidir.<\/li>\n\n\n\n<li><strong>Bildirim \u015eart\u0131:<\/strong> Yeni malik, ta\u015f\u0131nmaz\u0131 sat\u0131n ald\u0131ktan sonra kirac\u0131ya en az <strong>1 ay i\u00e7inde<\/strong> noter kanal\u0131yla yaz\u0131l\u0131 bildirimde bulunmal\u0131d\u0131r.<\/li>\n\n\n\n<li><strong>Dava A\u00e7ma S\u00fcresi:<\/strong> Tahliye davas\u0131, ta\u015f\u0131nmaz\u0131n yeni malik taraf\u0131ndan sat\u0131n al\u0131nd\u0131\u011f\u0131 tarihten itibaren en ge\u00e7 <strong>6 ay i\u00e7inde<\/strong> a\u00e7\u0131lmal\u0131d\u0131r.<\/li>\n<\/ol>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"aioseo-yeni-malikin-tahliye-davasi-nasil-acilir\">Yeni Malikin Tahliye Davas\u0131 Nas\u0131l A\u00e7\u0131l\u0131r?<\/h3>\n\n\n\n<p>Yeni malikin tahliye davas\u0131 a\u00e7ma s\u00fcreci \u015fu ad\u0131mlardan olu\u015fur:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>\u00d6n Haz\u0131rl\u0131k:<\/strong> Tapu kayd\u0131n\u0131n ve kira s\u00f6zle\u015fmesinin temin edilmesi gerekmektedir. Ayr\u0131ca, noter arac\u0131l\u0131\u011f\u0131yla kirac\u0131ya yap\u0131lan tahliye bildirimine ait belgeler haz\u0131rlanmal\u0131d\u0131r.<\/li>\n\n\n\n<li><strong>Dava Dilek\u00e7esi:<\/strong> Yetkili sulh hukuk mahkemesine hitaben bir dava dilek\u00e7esi haz\u0131rlan\u0131r. Dilek\u00e7ede, tahliye talebinin gerek\u00e7eleri ve yasal dayanaklar\u0131 ayr\u0131nt\u0131l\u0131 \u015fekilde a\u00e7\u0131klanmal\u0131d\u0131r.<\/li>\n\n\n\n<li><strong>Davan\u0131n A\u00e7\u0131lmas\u0131:<\/strong> Haz\u0131rlanan dilek\u00e7e ve ekler, yetkili sulh hukuk mahkemesine sunularak dava a\u00e7\u0131l\u0131r. Alan\u0131nda uzman avukatlar\u0131m\u0131z, dava s\u00fcrecinin her a\u015famas\u0131nda yan\u0131n\u0131zdad\u0131r. \u0130stanbul&#8217;da g\u00fcvenilir ve deneyimli bir avukat ar\u0131yorsan\u0131z, bizimle ileti\u015fime ge\u00e7ebilirsiniz.<\/p>\n\n\n\n<p>\u00dclkemizde 1 Temmuz 2012 tarihinde y\u00fcr\u00fcrl\u00fc\u011fe giren&nbsp;<strong><a href=\"http:\/\/www.resmigazete.gov.tr\/eskiler\/2011\/02\/20110204-1.htm\">6098 T\u00fcrk Bor\u00e7lar Kanunu<\/a><\/strong>,&nbsp;<strong><a href=\"http:\/\/www.mevzuat.gov.tr\/MevzuatMetin\/5.3.6570.pdf\">6570 Say\u0131l\u0131 Gayrimenkul Kiralar\u0131 Hakk\u0131nda Kanun<\/a><\/strong>u y\u00fcr\u00fcrl\u00fckten kald\u0131rm\u0131\u015ft\u0131r.&nbsp;<strong>Evi satmak kiray\u0131 \u00e7\u0131karmak i\u00e7in bir sebep de\u011fildir<\/strong>. Evi satacak olan ki\u015fi i\u00e7inde kirac\u0131 ile satmak durumundad\u0131r. Bu durumda evi yeni alan malikin belli haklar\u0131 s\u00f6z konusudur.<\/p>\n\n\n\n<p>Kira konusu yeri sonradan edinen yeni malikin o yere kendisinin, e\u015finin, altsoyunun, \u00fcstsoyunun veya bakmakla y\u00fck\u00fcml\u00fc oldu\u011fu ki\u015filerin ihtiyac\u0131 olmas\u0131 sonucu iktisaptan itibaren&nbsp;<strong>bir ay<\/strong>&nbsp;i\u00e7inde kirac\u0131ya yaz\u0131l\u0131 bildirim yapmal\u0131d\u0131r.<\/p>\n\n\n\n<p>Bildirimin varmas\u0131yla iktisaptan itibaren&nbsp;<strong>6 ay sonra<\/strong>&nbsp;ve s\u00f6zle\u015fmenin bitiminden sonra 1 ay i\u00e7erisinde&nbsp;<strong>yeni malikin tahliye davas\u0131<\/strong>&nbsp;a\u00e7\u0131lmal\u0131d\u0131r. Yine burada da yukar\u0131daki ihtiya\u00e7 nedeni ile tahliye davas\u0131 t\u00fcr\u00fcndeki&nbsp;<strong>ihtiyac\u0131n ispat\u0131<\/strong>&nbsp;bak\u0131m\u0131ndan ayn\u0131 \u015fartlar mevcuttur.<\/p>\n\n\n\n<p>Ancak burada belirtmek gerekir ki kirac\u0131 evi sat\u0131n almak isteyenlere evi g\u00f6stermek zorundad\u0131r. Bu davan\u0131n a\u00e7\u0131labilmesi i\u00e7in \u00f6ncelikle yeni malikin tapu kayd\u0131n\u0131n bulunmas\u0131 ve ta\u015f\u0131nmaz\u0131 kendisi veya birinci derece yak\u0131nlar\u0131 i\u00e7in konut ya da i\u015fyeri olarak kullanma niyetinde olmas\u0131 gerekmektedir. <\/p>\n\n\n\n<p>Ta\u015f\u0131nmaz\u0131n yeni maliki, sat\u0131n alma i\u015fleminden sonraki <strong>bir ay<\/strong> i\u00e7inde kirac\u0131ya noter arac\u0131l\u0131\u011f\u0131yla yaz\u0131l\u0131 bildirimde bulunmal\u0131 ve tahliye talebini iletmelidir.
