Ancak Sanayi Devrimi ile beraber fabrika sahiplerine ba\u011fl\u0131 olarak \u00e7al\u0131\u015fan i\u015f\u00e7ilerin say\u0131s\u0131 h\u0131zla artm\u0131\u015f, toplumda \u2018i\u015f\u00e7i s\u0131n\u0131f\u0131\u2019 olarak adland\u0131r\u0131lan yeni bir kesim olu\u015fmu\u015ftur. Bu d\u00f6nemde kad\u0131n ve \u00e7ocuklar sanayide ac\u0131mas\u0131zca kullan\u0131lm\u0131\u015f, i\u015f\u00e7iler g\u00fcnde 14 saat gibi a\u011f\u0131r \u00e7al\u0131\u015fma ko\u015fullar\u0131na maruz kalm\u0131\u015ft\u0131r. T\u00fcm bu zorluklara kar\u015f\u0131 i\u015f\u00e7i kesim birle\u015fmi\u015f, kendi haklar\u0131n\u0131 aramaya ba\u015flam\u0131\u015f ve zaman i\u00e7erisinde i\u015f\u00e7ileri ve i\u015f\u00e7i haklar\u0131n\u0131 koruma amac\u0131yla \u0130\u015f Hukuku olu\u015fturulmu\u015ftur.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"aioseo-is-davasi-avukati\">\u0130\u015f Davas\u0131 Avukat\u0131<\/h3>\n\n\n\n<p><strong>\u0130\u015f, i\u015f\u00e7i, i\u015fveren gibi konular\u0131 ele alan, i\u015f\u00e7i ve i\u015fveren aras\u0131ndaki ili\u015fkiyi inceleyen ve bu konuda ortaya \u00e7\u0131kabilecek uyu\u015fmazl\u0131klar\u0131 d\u00fczenleyen hukuk dal\u0131na \u0130\u015f Hukuku denir.<\/strong><\/p>\n\n\n\n<p><strong>\u0130\u015f Hukuku<\/strong>&nbsp;kendi i\u00e7erisinde&nbsp;<strong>Bireysel \u0130\u015f Hukuku<\/strong>&nbsp;ve&nbsp;<strong>Toplu \u0130\u015f Hukuku<\/strong>&nbsp;olmak \u00fczere ikiye ayr\u0131lmaktad\u0131r. Bireysel \u0130\u015f Hukuku; i\u015f\u00e7i ve i\u015fveren aras\u0131ndaki s\u00f6zle\u015fmelerin yap\u0131lmas\u0131, asgari \u00fccret, \u00e7al\u0131\u015fma s\u00fcreleri, izin haklar\u0131, s\u00f6zle\u015fmenin feshi ve tazminat gibi konular\u0131 incelemektedir. Toplu \u0130\u015f Hukuku ise; sendikalar\u0131n kurulu\u015funu, faaliyetlerini, toplu i\u015f s\u00f6zle\u015fmelerinin yap\u0131lmas\u0131n\u0131, grev ve lokavta gidilmesi \u015fartlar\u0131 incelemektedir.<\/p>\n\n\n\n<p><strong>\u0130\u015f hukuku<\/strong>&nbsp;her ne kadar \u00e7al\u0131\u015fma ili\u015fkilerini d\u00fczenleyen bir hukuk dal\u0131 olsa da, her \u00e7al\u0131\u015fma ili\u015fkisi bu hukuk dal\u0131 kapsamda de\u011ferlendirilmez. Zira \u0130\u015f Hukukunun kapsam\u0131na sadece; i\u015f\u00e7i stat\u00fcs\u00fcnde i\u015f g\u00f6renler ile bunlar\u0131 \u00e7al\u0131\u015ft\u0131ranlar girmektedir. Bu bak\u0131mdan kanunda yap\u0131lan i\u015f\u00e7i ve i\u015fveren tan\u0131mlar\u0131 b\u00fcy\u00fck \u00f6nem arz etmekte olup, aradaki uyu\u015fmazl\u0131\u011fa hangi hukukun uygulanaca\u011f\u0131n\u0131n bulunmas\u0131nda \u00f6nemli rol oynamaktad\u0131r.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"aioseo-is-hukukuna-iliskin-uyusmazliklar-ve-uygulanacak-kanunlar\">\u0130\u015f Hukukuna \u0130li\u015fkin Uyu\u015fmazl\u0131klar ve Uygulanacak Kanunlar<\/h2>\n\n\n\n<p>\u0130\u015f hukukuna ili\u015fkin d\u00fczenlemelerin as\u0131l olarak&nbsp;<strong><a href=\"http:\/\/www.mevzuat.gov.tr\/Metin1.Aspx?MevzuatKod=1.5.4857&amp;MevzuatIliski=0&amp;sourceXmlSearch&amp;Tur=1&amp;Tertip=5&amp;No=4857\">4857 say\u0131l\u0131 \u0130\u015f Kanunu<\/a><\/strong>\u2019nda bulunmaktad\u0131r. Dolay\u0131s\u0131yla bir hukuki uyu\u015fmazl\u0131\u011f\u0131n olmas\u0131 durumunda ilk olarak bu kanuna bak\u0131lmas\u0131 gerekmektedir. Bunun d\u0131\u015f\u0131nda;&nbsp;<strong><a href=\"http:\/\/www.mevzuat.gov.tr\/Metin1.Aspx?MevzuatKod=1.5.6356&amp;MevzuatIliski=0&amp;sourceXmlSearch=&amp;Tur=1&amp;Tertip=5&amp;No=6356\">6356 say\u0131l\u0131 Sendikalar ve Toplu \u0130\u015f S\u00f6zle\u015fmesi Kanunu<\/a><\/strong>\u2018nda,&nbsp;<strong><a href=\"http:\/\/www.mevzuat.gov.tr\/MevzuatMetin\/1.5.854.pdf\">854 say\u0131l\u0131 Deniz \u0130\u015f Kanunu<\/a><\/strong>\u2018nda,&nbsp;<strong><a href=\"http:\/\/www.mevzuat.gov.tr\/Metin.Aspx?MevzuatKod=1.3.5953&amp;MevzuatIliski=0&amp;sourceXmlSearch\">5953 say\u0131l\u0131 Bas\u0131n \u0130\u015f Kanunu<\/a><\/strong>\u2018nda,&nbsp;<strong><a href=\"https:\/\/www.tbmm.gov.tr\/tutanaklar\/KANUNLAR_KARARLAR\/kanuntbmmc071\/kanuntbmmc071\/kanuntbmmc07103451.pdf\">2822 say\u0131l\u0131 Toplu \u0130\u015f S\u00f6zle\u015fmesi<\/a><\/strong>,&nbsp;<strong><a href=\"http:\/\/mevzuat.basbakanlik.gov.tr\/Metin1.Aspx?MevzuatKod=1.5.2822&amp;MevzuatIliski=0&amp;sourceXmlSearch=2822&amp;Tur=1&amp;Tertip=5&amp;No=2822\">Grev ve Lokavt Kanunu<\/a><\/strong>&nbsp;\u2026 gibi kanunlarda i\u015f hukukuna ili\u015fkin d\u00fczenlemeler bulunmaktad\u0131r. Bu kanunlar daha \u00f6zel nitelikli kanunlar olup, bu kanunlar\u0131n alan\u0131na giren uyu\u015fmazl\u0131\u011f\u0131n bulunmas\u0131 durumunda ilgili kanunun h\u00fck\u00fcmlerinin uygulanmas\u0131 gerekmektedir. Ayr\u0131ca baz\u0131 hallerde 6098 say\u0131l\u0131 Bor\u00e7lar Kanunu\u2019nun da uygulanmas\u0131 s\u00f6z konusu olmaktad\u0131r.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"aioseo-ise-iade-davasi\">\u0130\u015fe \u0130ade Davas\u0131<\/h2>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"683\" src=\"https:\/\/turkeylegal.com.tr\/tr\/wp-content\/uploads\/2024\/06\/Ise-Iade-Davasi-1024x683.jpg\" alt=\"\u0130\u015fe \u0130ade Davas\u0131\" class=\"wp-image-24827\" srcset=\"https:\/\/turkeylegal.com.tr\/tr\/wp-content\/uploads\/2024\/06\/Ise-Iade-Davasi-1024x683.jpg 1024w, https:\/\/turkeylegal.com.tr\/tr\/wp-content\/uploads\/2024\/06\/Ise-Iade-Davasi-300x200.jpg 300w, https:\/\/turkeylegal.com.tr\/tr\/wp-content\/uploads\/2024\/06\/Ise-Iade-Davasi-768x512.jpg 768w, https:\/\/turkeylegal.com.tr\/tr\/wp-content\/uploads\/2024\/06\/Ise-Iade-Davasi.jpg 1200w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<p>\u0130\u015f\u00e7i, fesih bildiriminde sebep g\u00f6sterilmedi\u011fi veya g\u00f6sterilen sebebin ge\u00e7erli bir sebep olmad\u0131\u011f\u0131 iddias\u0131 ile i\u015f kanununun 20.maddesine g\u00f6re fesih bildiriminin tebli\u011fi tarihinden itibaren bir ay i\u00e7inde yetkili i\u015f mahkemesinde i\u015fe iade davas\u0131 a\u00e7mas\u0131 gerekir. Madde h\u00fckm\u00fcne g\u00f6re, fesih tarihinin de\u011fil, feshin bildirildi\u011fi tarihin esas al\u0131nmas\u0131 gerekti\u011fi a\u00e7\u0131kt\u0131r. Bu nedenle bir ayl\u0131k hak d\u00fc\u015f\u00fcr\u00fcc\u00fc s\u00fcre ihbar s\u00fcresinin sonunda ger\u00e7ekle\u015fen fesih tarihi itibariyle de\u011fil, feshin bildirildi\u011fi tarih itibariyle i\u015flemeye ba\u015flar. Bu s\u00fcre hak d\u00fc\u015f\u00fcr\u00fcc\u00fc s\u00fcre oldu\u011fundan mahkemece re\u2019sen dikkate al\u0131n\u0131r.<\/p>\n\n\n\n<p>\u0130\u015f\u00e7inin&nbsp;<strong>i\u015fe iade davas\u0131<\/strong>&nbsp;a\u00e7abilmesi i\u00e7in, o i\u015fletmenin b\u00fct\u00fcn\u00fcnde en az otuz i\u015f\u00e7i \u00e7al\u0131\u015fmas\u0131 ve belirsiz s\u00fcreli i\u015f s\u00f6zle\u015fmesi ile \u00e7al\u0131\u015fmas\u0131 ve sigorta kay\u0131tlar\u0131na g\u00f6re o i\u015fyerinde en az 6 ayl\u0131k k\u0131deminin bulunmas\u0131 gerekir.<\/p>\n\n\n\n<p>\u0130\u015fveren yapt\u0131\u011f\u0131 fesih ile birlikte i\u015f\u00e7inin her t\u00fcrl\u00fc yasal haklar\u0131n\u0131 \u00f6demi\u015f olsa dahi (ihbar, k\u0131dem tazminat\u0131, y\u0131ll\u0131k izin, fazla \u00e7al\u0131\u015fma \u00fccreti vs.) bu durum i\u015f\u00e7inin bu davay\u0131 a\u00e7mas\u0131na engel de\u011fildir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"aioseo-ise-iade-davasi-sartlari-nedir\">\u0130\u015fe \u0130ade Davas\u0131 \u015eartlar\u0131 Nedir?<\/h2>\n\n\n\n<p>\u0130\u015f\u00e7inin&nbsp;<em>i\u015fe iade talebi<\/em>nde bulunmas\u0131 yeterlidir. Feshin ge\u00e7ersizli\u011fine ba\u011fl\u0131 olan tazminat ve bo\u015fta ge\u00e7en s\u00fcre \u00fccret alaca\u011f\u0131 tespit niteli\u011finde oldu\u011fundan bunlar\u0131n ka\u00e7 ayl\u0131k \u00fccret tutar\u0131nda olaca\u011f\u0131 belirlenecek ayr\u0131ca tazminat miktar\u0131 ve tahsile ili\u015fkin h\u00fck\u00fcm kurulmayacakt\u0131r.<\/p>\n\n\n\n<p>Tebligat Kanunu\u2019nun 11. maddesine g\u00f6re vekille takip edilen i\u015flerde tebligat\u0131n vekile yap\u0131lmas\u0131 zorunludur. Buna g\u00f6re kesinle\u015fmi\u015f i\u015fe iade karar\u0131, dava avukat ile takip edilmi\u015f ise ancak avukata yap\u0131lan tebligat ile on g\u00fcnl\u00fck s\u00fcreyi ba\u015flat\u0131r.<\/p>\n\n\n\n<p>\u0130\u015f\u00e7i i\u015fe ba\u015flamak i\u00e7in i\u015fverene bizzat ba\u015fvurabilece\u011fi gibi vas\u0131tal\u0131 yollarla da (noter veya iadeli taahh\u00fctl\u00fc mektup kanal\u0131yla ve vekil arac\u0131l\u0131\u011f\u0131yla da) i\u015fe ba\u015flama iradesini i\u015fverene ula\u015ft\u0131rabilir. Yeter ki on g\u00fcnl\u00fck s\u00fcre ge\u00e7meden bu ba\u015fvuru yap\u0131labilsin.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"aioseo-ise-iade-sureci-nasil-isler\">\u0130\u015fe \u0130ade S\u00fcreci Nas\u0131l \u0130\u015fler?<\/h2>\n\n\n\n<p>On i\u015f g\u00fcn\u00fc i\u00e7inde yeniden i\u015fe ba\u015flat\u0131lma talebiyle i\u015fverene ba\u015fvurdu\u011funda i\u015fveren bir ay i\u00e7inde i\u015fe ba\u015flatmaz ise, i\u015f\u00e7iye en az d\u00f6rt ayl\u0131k ve en \u00e7ok sekiz ayl\u0131k \u00fccreti tutar\u0131nda i\u015f g\u00fcvencesi tazminat\u0131 \u00f6demek zorunda kal\u0131r.<\/p>\n\n\n\n<p>\u0130\u015f\u00e7i,&nbsp;<strong><em>i\u015fe iade karar\u0131&nbsp;<\/em><\/strong>\u00fczerine, i\u015fverene ba\u015fvurduktan sonra, muaccel hale gelen bo\u015fta ge\u00e7en s\u00fcre i\u00e7in 4 aya kadar \u00fccret ve di\u011fer haklar\u0131n\u0131n alacak olarak belirlenmesi ve miktar olarak h\u00fck\u00fcm alt\u0131na al\u0131nmas\u0131 i\u00e7in ikinci bir dava a\u00e7t\u0131\u011f\u0131nda \u00f6denmesi gereken haklar\u0131 hesap bilirki\u015fisine hesaplatt\u0131r\u0131lmal\u0131 ve eda niteli\u011finde h\u00fck\u00fcm kurulmal\u0131d\u0131r. Ayr\u0131ca, de\u011fer dikkate al\u0131narak nispi karar harc\u0131 ve vek\u00e2let \u00fccretine karar verilmelidir.<\/p>\n\n\n\n<p><strong>\u0130\u015fe iade davas\u0131<\/strong>&nbsp;a\u00e7\u0131ld\u0131ktan sonra daha dava sonu\u00e7lanmadan i\u015fveren i\u015f\u00e7iyi tekrar i\u015fe ba\u015flat\u0131rsa bu durumda dava konusuz kalacakt\u0131r. Yarg\u0131tay\u2019a g\u00f6re; i\u015f\u00e7inin, bo\u015fta ge\u00e7en s\u00fcre i\u00e7in \u00fccrete hak kazanmas\u0131, feshin ge\u00e7ersizli\u011fine karar verilmi\u015f olmas\u0131 ve i\u015f\u00e7inin s\u00fcresinde i\u015fe iade i\u00e7in i\u015fverene ba\u015fvurmas\u0131 \u015fartlar\u0131na ba\u011fl\u0131d\u0131r. Bu durumda konusuz kalan davada feshin ge\u00e7ersizli\u011fine ve i\u015fe iade karar\u0131 verilmedi\u011finden mahkeme i\u015f\u00e7inin \u00e7al\u0131\u015ft\u0131r\u0131lmad\u0131\u011f\u0131 s\u00fcre i\u00e7in en \u00e7ok d\u00f6rt ayl\u0131k \u00fccrete karar veremez.<\/p>\n\n\n\n<p>\u0130\u015fe iade talebi ile birlikte i\u015f akdinin feshinden do\u011fan k\u0131dem \u2013 ihbar tazminat\u0131 ile \u00f6denmemi\u015f \u00fccret gibi i\u015f\u00e7ilik alacaklar\u0131 talep edilemez. \u00c7\u00fcnk\u00fc hem feshin ge\u00e7ersizli\u011fi ile i\u015fe iade talep edilirken di\u011fer yandan feshin sonucuna ba\u011fl\u0131 olan tazminatlar\u0131n istenmesi \u00e7eli\u015fkidir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"aioseo-ise-iade-davasi\">\u0130\u015fe \u0130ade Davas\u0131<\/h2>\n\n\n\n<p>Yarg\u0131tay\u2019a g\u00f6re; i\u015fe iade ve k\u0131dem \u2013 ihbar tazminat\u0131 gibi do\u011fu\u015fu i\u015f akdinin sona ermesine ba\u011fl\u0131 i\u015f\u00e7ilik haklar\u0131 birlikte talep edilen davalarda \u00f6ncelikle davalar\u0131n ayr\u0131lmas\u0131na karar verilerek i\u015fe iade davas\u0131n\u0131n sonucu kesinle\u015finceye kadar k\u0131dem-ihbar tazminat\u0131 talepli davada bekletici mesele yap\u0131lacakt\u0131r.<\/p>\n\n\n\n<p>Yasan\u0131n d\u00fczenlemesi gere\u011fi bu s\u00fcrenin d\u00f6rt aya kadar \u00fccret ve di\u011fer yasal haklar\u0131n\u0131n \u00f6denmesine karar verilen s\u00fcre; ihbar k\u0131dem tazminat\u0131 ve y\u0131ll\u0131k \u00fccretli izin alaca\u011f\u0131n\u0131n hesab\u0131nda nazara al\u0131nmas\u0131 gerekmektedir. Ba\u015fka bir deyi\u015fle;<strong>&nbsp;i\u015fe iade davas\u0131n\u0131&nbsp;<\/strong>kazand\u0131\u011f\u0131 halde i\u015fe ba\u015flat\u0131lmayan i\u015f\u00e7i k\u0131dem ve ihbar tazminat\u0131 i\u00e7in dava a\u00e7t\u0131\u011f\u0131nda hizmet s\u00fcresine 4 (d\u00f6rt) ay eklenecektir.<\/p>\n\n\n\n<p>Belirtmek gerekir ki, feshin ge\u00e7ersizli\u011fi ve&nbsp;i\u015fe iade isteminde bulunan&nbsp;i\u015f\u00e7inin, bo\u015fta ge\u00e7en s\u00fcre i\u00e7erisinde yeni bir i\u015f bulmas\u0131, feshin ge\u00e7ersizli\u011fini ve i\u015fe iadeyi etkileyen bir unsur de\u011fildir. Kanunda bu y\u00f6nde d\u00fczenleme olmad\u0131\u011f\u0131 gibi, \u00e7al\u0131\u015fma halinde bu s\u00fcrenin bo\u015fta ge\u00e7en s\u00fcreden mahsup edilece\u011fine dair bir kurala da yer verilmemi\u015ftir.<\/p>\n\n\n\n<p>Sonu\u00e7 olarak i\u015f\u00e7i&nbsp;i\u015fe iade davas\u0131&nbsp;a\u00e7t\u0131ktan sonra kar\u015f\u0131s\u0131na \u00e7\u0131kan i\u015f imk\u00e2nlar\u0131n\u0131 de\u011ferlendirebilir. Her \u015feyden \u00f6nce \u00e7al\u0131\u015fma hakk\u0131 Anayasal ve temel bir hakt\u0131r ve i\u015f\u00e7inin a\u00e7t\u0131\u011f\u0131 dava nedeniyle dava sonu\u00e7lanana kadar \u00e7al\u0131\u015fmamas\u0131 gerekti\u011fi d\u00fc\u015f\u00fcn\u00fclemez. Maddesi i\u015f kazas\u0131n\u0131 tan\u0131mlam\u0131\u015ft\u0131r. Be\u015f durum halinde say\u0131lan bu olaylardan birinin ger\u00e7ekle\u015fmesi halinde i\u015f kazas\u0131ndan bahsedilecektir;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Sigortal\u0131n\u0131n i\u015fyerinde bulundu\u011fu s\u0131rada meydana gelen her t\u00fcrl\u00fc kaza i\u015f kazas\u0131 say\u0131lmaktad\u0131r. G\u00f6r\u00fcld\u00fc\u011f\u00fc gibi kazan\u0131n i\u015f yerinde ger\u00e7ekle\u015fmesi yeterli olup, fiilen \u00e7al\u0131\u015f\u0131rken ya da dinlenme s\u00fcresinde ya\u015fanmas\u0131 \u00f6nem arz etmemektedir. \u00d6rne\u011fin, i\u015f\u00e7inin i\u015fyerinde intihar etmesi ya da hasm\u0131 taraf\u0131ndan vurulmas\u0131 i\u015f kazas\u0131 say\u0131lmaktad\u0131r.<\/li>\n\n\n\n<li>\u0130\u015fveren taraf\u0131ndan y\u00fcr\u00fct\u00fclmekte olan i\u015f nedeniyle sigortal\u0131 kendi ad\u0131na ve hesab\u0131na ba\u011f\u0131ms\u0131z \u00e7al\u0131\u015f\u0131yorsa y\u00fcr\u00fctmekte oldu\u011fu i\u015f nedeniyle kazaya u\u011franmas\u0131 durumunda da i\u015f kazas\u0131 var say\u0131lacakt\u0131r. \u00d6nemli olan kazan\u0131n i\u015f g\u00f6r\u00fcl\u00fcrken ger\u00e7ekle\u015fmesidir. Kazan\u0131n nas\u0131l ger\u00e7ekle\u015fti\u011finin \u00f6nemi yoktur. Ba\u015fka bir \u00fclkede ger\u00e7ekle\u015fse bile bu kapsamdad\u0131r.<\/li>\n\n\n\n<li>Emziren kad\u0131n sigortal\u0131n\u0131n, i\u015f mevzuat\u0131 gere\u011fince \u00e7ocu\u011funa s\u00fct vermek i\u00e7in ayr\u0131lan zamanlarda u\u011frad\u0131\u011f\u0131 kaza da i\u015f kazas\u0131d\u0131r. Kazan\u0131n i\u015fyerinde ger\u00e7ekle\u015fmesi \u00f6nemli de\u011fildir, \u00f6nemli olan kazan\u0131n i\u015fveren taraf\u0131ndan verilen emzirme s\u00fcresinde ger\u00e7ekle\u015fmesidir.<\/li>\n\n\n\n<li>Sigortal\u0131lar\u0131n, i\u015fverence sa\u011flanan bir ta\u015f\u0131tla i\u015fin yap\u0131ld\u0131\u011f\u0131 yere gidi\u015f geli\u015fi s\u0131ras\u0131nda u\u011frad\u0131\u011f\u0131 kazalar da i\u015f kazas\u0131 kapsam\u0131ndad\u0131r. \u00d6rne\u011fin i\u015fe gitmek i\u00e7in servis bekleyen i\u015f\u00e7iye bir arac\u0131n \u00e7arpmas\u0131 durumunda i\u015f kazas\u0131 mevcuttur.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"aioseo-zarar-gorme\">Zarar G\u00f6rme<\/h2>\n\n\n\n<p>\u0130\u015f\u00e7inin i\u015f kazas\u0131na ba\u011fl\u0131 haklardan yararlanabilmesi i\u00e7in kaza an\u0131nda veya sonradan bedenen ya da ruhen bir zarara u\u011framas\u0131 gerekmektedir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"aioseo-zarar-goren-sigortali-olmalidir\">Zarar G\u00f6ren Sigortal\u0131 Olmal\u0131d\u0131r<\/h2>\n\n\n\n<p>Bir i\u015f s\u00f6zle\u015fmesi gere\u011fi i\u015fveren taraf\u0131ndan \u00e7al\u0131\u015ft\u0131r\u0131lanlar kendili\u011finden sigortal\u0131 say\u0131l\u0131rlar. Bu ba\u011flamda i\u015fverence bildirilmemelerinin \u00f6nemi yoktur. Burada bahsi ge\u00e7en i\u015f s\u00f6zle\u015fmesi \u0130\u015f Kanunu\u2019ndan do\u011fabilece\u011fi gibi Deniz \u0130\u015f Kanunu, Bas\u0131n \u0130\u015f Kanunu ve benzerleri kapsam\u0131nda da yer alabilir.<\/p>\n\n\n\n<p>Di\u011fer bir \u015fart olarak i\u015f\u00e7i en az 1 y\u0131l \u00e7al\u0131\u015fm\u0131\u015f olmal\u0131d\u0131r. Bu s\u00fcreye tatil ve benzeri s\u00fcreler d\u00e2hilken grev veya lokavt nedeniyle s\u00f6zle\u015fmenin ask\u0131da oldu\u011fu s\u00fcreler d\u00e2hil de\u011fildir. Ayr\u0131ca i\u015f\u00e7inin i\u015f ili\u015fkisinde 2 aya kadar deneme s\u00fcresi mevcutsa bu deneme s\u00fcresi de dikkate al\u0131nmal\u0131d\u0131r.<\/p>\n\n\n\n<p>K\u0131deme esas s\u00fcre hesaplan\u0131rken ayn\u0131 i\u015fverenin de\u011fi\u015fik i\u015fyerlerinde \u00e7al\u0131\u015fan i\u015f\u00e7inin k\u0131demi birlikte hesaplan\u0131r. E\u011fer i\u015f\u00e7iler, ayn\u0131 anda birden fazla i\u015fverene hizmet ediyorlarsa ve bu i\u015fverenler aras\u0131nda organik ba\u011f tespit edilirse bu durumda da s\u00fcre birlikte hesaplan\u0131r. Mevsimlik i\u015f\u00e7ilerin k\u0131demi i\u00e7in, \u00e7al\u0131\u015ft\u0131klar\u0131 s\u00fcre toplan\u0131r. Kanun koyucu mevsimlik i\u015f\u00e7iler i\u00e7in bu d\u00fczenlemeyi getirerek s\u00fcre bak\u0131m\u0131ndan ma\u011fduriyetlerini engellemeyi hedeflemi\u015ftir. K\u0131smi s\u00fcreli \u00e7al\u0131\u015fan i\u015f\u00e7inin k\u0131demi ise tam s\u00fcreli \u00e7al\u0131\u015fan i\u015f\u00e7i gibi hesaplan\u0131r; i\u015fe ba\u015flama ve i\u015ften ayr\u0131lma aras\u0131nda ge\u00e7en s\u00fcre dikkate al\u0131n\u0131r. \u0130\u015fyeri devredilmi\u015fse yeni i\u015fveren, i\u015f\u00e7inin eski i\u015fverenin yan\u0131nda \u00e7al\u0131\u015ft\u0131\u011f\u0131 s\u00fcre i\u00e7in eski i\u015fverene r\u00fccu edebilir.<\/p>\n\n\n\n<p><em>K\u0131dem tazminat\u0131<\/em>na hak kazan\u0131lmas\u0131 i\u00e7in i\u015f s\u00f6zle\u015fmesinin belirli nedenlerle sona ermi\u015f olmas\u0131 gerekmektedir.<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>\u0130\u015f s\u00f6zle\u015fmesi \u0130\u015f Kanunu 25\/2 h\u00fckm\u00fcnde g\u00f6sterilen nedenler d\u0131\u015f\u0131nda bir nedenle sona erdirilirse i\u015f\u00e7i k\u0131deme hak kazan\u0131r. Fakat 25\/2, yani ahlak ve iyiniyet kurallar\u0131na dayal\u0131 nedenlerle i\u015fverence feshedilirse i\u015f\u00e7i&nbsp;<strong>k\u0131dem tazminat\u0131na&nbsp;<\/strong>hak kazanamaz.<\/li>\n\n\n\n<li>Kanunun 24. Maddesine g\u00f6re i\u015f\u00e7inin hakl\u0131 nedenle feshi durumunda i\u015f\u00e7i k\u0131deme hak kazanacakt\u0131r. Fakat 17. Maddeye dayal\u0131 fesih varsa i\u015f\u00e7i k\u0131deme hak kazanamaz<\/li>\n\n\n\n<li>Kad\u0131n i\u015f\u00e7i evlilik nedeniyle i\u015f s\u00f6zle\u015fmesini feshederse, resmi evlilik i\u015fleminin tamamlanmas\u0131ndan itibaren 1 y\u0131l i\u00e7inde ba\u015fvurarak&nbsp;<em>k\u0131dem tazminat\u0131&nbsp;<\/em>talep edebilir. Bu hak, sadece kad\u0131na tan\u0131nm\u0131\u015f olup, erkek i\u015f\u00e7i taraf\u0131ndan kullan\u0131lamaz. Ayr\u0131ca belirtmek gerekir ki do\u011fum yapma hali i\u00e7in benzer bir d\u00fczenlemeye kanunda yer verilmemi\u015ftir.<\/li>\n\n\n\n<li>Erkek i\u015f\u00e7inin \u00e7al\u0131\u015fm\u0131\u015f oldu\u011fu i\u015fyerinde askerlik vazifesi nedeniyle i\u015f s\u00f6zle\u015fmesini feshederse&nbsp;<strong>k\u0131dem tazminat\u0131<\/strong>&nbsp;hakk\u0131 do\u011facakt\u0131r. Ayr\u0131ca i\u015f\u00e7inin burada ihbar y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcne uymas\u0131 da gerekmez.<\/li>\n\n\n\n<li>Ya\u015fl\u0131l\u0131k, malull\u00fck, emeklilik sebebiyle ya da toptan \u00f6deme almak amac\u0131yla yap\u0131lan fesih sonunda i\u015f\u00e7i&nbsp;<em>k\u0131dem tazminat\u0131<\/em>na hak kazan\u0131r.<\/li>\n\n\n\n<li>\u0130\u015f\u00e7inin \u00f6lmesi halinde kanuni miras\u00e7\u0131lar k\u0131dem tazminat\u0131na hak kazan\u0131r.<\/li>\n<\/ol>\n\n\n\n<p>K\u0131dem tazminat\u0131n\u0131n tutar\u0131, i\u015f\u00e7inin \u00e7al\u0131\u015ft\u0131\u011f\u0131 her y\u0131l i\u00e7in 30 g\u00fcnl\u00fck \u00fccrettir. Burada esas al\u0131nacak \u00fccret i\u015f\u00e7inin son giydirilmi\u015f \u00fccretidir yani prim, ikramiye d\u00e2hildir. 1 y\u0131ldan sonra artan s\u00fcreler i\u00e7in orant\u0131l\u0131 \u00fccret \u00f6denir. K\u0131dem tazminat\u0131n\u0131n miktar\u0131 toplu i\u015f s\u00f6zle\u015fmesiyle veya i\u015f s\u00f6zle\u015fmesiyle art\u0131r\u0131labilir. \u0130\u015fverenler son \u00fccret \u00fczerinden k\u0131dem tazminat\u0131 y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcnden kurtulmak i\u00e7in k\u00f6t\u00fcniyetli olarak i\u015f s\u00f6zle\u015fmesini feshederek i\u015f\u00e7iyi yeniden i\u015fe ba\u015flatma yoluna ba\u015fvurmay\u0131 deneyebilirler. Bu ba\u011flamda gerekli ihbarlar\u0131, \u00f6ng\u00f6r\u00fclen zamanda yerine getirmeyen taraf (i\u015f\u00e7i ya da i\u015fveren fark etmez) bu durumun sonu\u00e7lar\u0131na katlanacakt\u0131r.<\/p>\n\n\n\n<p>Somutla\u015ft\u0131rmak gerekirse; \u0130\u015f kanununa g\u00f6re i\u015f s\u00f6zle\u015fmeleri;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u0130\u015fi alt\u0131 aydan az s\u00fcrm\u00fc\u015f olan i\u015f\u00e7i i\u00e7in, bildirimin di\u011fer tarafa yap\u0131lmas\u0131ndan ba\u015flayarak iki hafta sonra,<\/li>\n\n\n\n<li>\u0130\u015fi alt\u0131 aydan birbu\u00e7uk y\u0131la kadar s\u00fcrm\u00fc\u015f olan i\u015f\u00e7i i\u00e7in, bildirimin di\u011fer tarafa yap\u0131lmas\u0131ndan ba\u015flayarak d\u00f6rt hafta sonra,<\/li>\n\n\n\n<li>\u0130\u015fi birbu\u00e7uk y\u0131ldan \u00fc\u00e7 y\u0131la kadar s\u00fcrm\u00fc\u015f olan i\u015f\u00e7i i\u00e7in, bildirimin di\u011fer tarafa yap\u0131lmas\u0131ndan ba\u015flayarak alt\u0131 hafta sonra,<\/li>\n\n\n\n<li>\u0130\u015fi \u00fc\u00e7 y\u0131ldan fazla s\u00fcrm\u00fc\u015f i\u015f\u00e7i i\u00e7in, bildirim yap\u0131lmas\u0131ndan ba\u015flayarak sekiz hafta sonra feshedilmi\u015f say\u0131lacakt\u0131r.<\/li>\n<\/ul>\n\n\n\n<p>\u00d6rnek olarak 7 ay \u00e7al\u0131\u015fm\u0131\u015f bir i\u015f\u00e7i, fesih bildiriminden itibaren 4 hafta daha \u00e7al\u0131\u015ft\u0131r\u0131lmal\u0131d\u0131r. Aksi takdirde i\u015f\u00e7iye ihbar tazminat\u0131 \u00f6denmelidir ki \u00f6denecek tazminat, yukar\u0131daki s\u00fcrelere denk gelen br\u00fct maa\u015f kadar olacakt\u0131r.<\/p>\n\n\n\n<p>\u0130hbar s\u00fcresi boyunca i\u015f\u00e7i tamamen ayn\u0131 ko\u015fullarla \u00e7al\u0131\u015fmaya devam eder. Tek fark, i\u015fveren i\u015f\u00e7iye g\u00fcnl\u00fck en az 2 saat i\u015f arama izni vermelidir. \u0130\u015f\u00e7i, \u00f6nceden haber vermek ve s\u00fcreleri g\u00f6stermek kayd\u0131yla i\u015f arama izni s\u00fcrelerini toplu kullanabilir. \u0130\u015fveren e\u011fer i\u015f\u00e7isine yeni i\u015f arama iznini kulland\u0131rtmazsa ya da eksik kulland\u0131r\u0131rsa, i\u015f\u00e7inin haketti\u011fi i\u015f arama izin s\u00fcresi \u00fccretinin yan\u0131 s\u0131ra, \u00e7al\u0131\u015ft\u0131\u011f\u0131 s\u00fcrenin \u00fccretini de y\u00fczde y\u00fcz zaml\u0131 olarak i\u015f\u00e7iye \u00f6der.<\/p>\n\n\n\n<p>\u0130hbar tazminat\u0131, kar\u015f\u0131 taraf\u0131 haz\u0131rl\u0131ks\u0131z \u015fekilde terk etmeme mant\u0131\u011f\u0131ndan kaynakland\u0131\u011f\u0131ndan, s\u00fcrelere uymayan i\u015f\u00e7inin de ihbar tazminat\u0131 \u00f6demek zorunda kalabilece\u011fi unutulmamal\u0131d\u0131r. Astlara, \u00fcstlere veya e\u015fit seviyedekilere kar\u015f\u0131 yap\u0131labilir.<\/p>\n\n\n\n<p>\u0130\u015f\u00e7iye kar\u015f\u0131 sergilenen davran\u0131\u015flar\u0131n&nbsp;<strong><em>mobbing&nbsp;<\/em><\/strong>olarak nitelendirilebilmesi i\u00e7in bunlar\u0131n sistematik olmas\u0131, aralar\u0131nda ba\u011flant\u0131 bulunmas\u0131, ki\u015finin psikolojisine kar\u015f\u0131 bir t\u00fcr sava\u015f niteli\u011finde olmas\u0131 ve son olarak da y\u0131ld\u0131rma amac\u0131 g\u00fctmesi gerekir. Ki\u015finin onurunu k\u0131r\u0131c\u0131, d\u0131\u015flay\u0131c\u0131, uzakla\u015ft\u0131rmaya y\u00f6neltici davran\u0131\u015flar buna \u00f6rnektir. Bu s\u00fcre\u00e7te i\u015f\u00e7iyi i\u015finden, i\u015f ortam\u0131ndan soyutlama amac\u0131 bar\u0131nd\u0131r\u0131r ve b\u00f6ylece i\u015f\u00e7inin i\u015f ili\u015fkisine son vermeyi istemesi sa\u011flan\u0131r.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"aioseo-mobbing-nedir-hangi-durumlar-mobbing-sayilir\">Mobbing Nedir, Hangi Durumlar Mobbing Say\u0131l\u0131r?<\/h2>\n\n\n\n<p>Bilindi\u011fi \u00fczere i\u015fveren i\u015f\u00e7iyi g\u00f6zetmek, onun ki\u015fili\u011fini koruyup sayg\u0131 g\u00f6stermekle ve i\u015fyerinde d\u00fcr\u00fcstl\u00fck ilkelerine uygun bir d\u00fczen sa\u011flamakla y\u00fck\u00fcml\u00fcd\u00fcr. Dolay\u0131s\u0131yla mobbing, i\u015fverenin i\u015f\u00e7iyi g\u00f6zetme borcuna ayk\u0131r\u0131l\u0131k te\u015fkil etmektedir. Yarg\u0131tay uygulamas\u0131 da mobbingin varl\u0131\u011f\u0131na dair kuvvetli olgular\u0131n bulunmas\u0131 halinde, tazminat hakk\u0131n\u0131n do\u011faca\u011f\u0131 y\u00f6n\u00fcndedir.<\/p>\n\n\n\n<p>T\u00fcm bunlara ek olarak&nbsp;mobbing, T\u00fcrk Ceza Kanunu i\u00e7erisinde do\u011frudan yer almasa da unsurlar\u0131 g\u00f6z \u00f6n\u00fcnde bulundurulunca hakaret, huzur ve s\u00fckunu bozma, tehdit, cinsel taciz, ayr\u0131mc\u0131l\u0131k, i\u015f ve \u00e7al\u0131\u015fma h\u00fcrriyetinin ihlali gibi su\u00e7lar\u0131n da kapsam\u0131na girebilir. Fazla s\u00fcrelerle \u00e7al\u0131\u015fma, i\u015f\u00e7inin haftal\u0131k \u00e7al\u0131\u015fma s\u00fcresinin 45 saatin alt\u0131nda belirlendi\u011fi durumlarda, belirlenen \u00e7al\u0131\u015fma s\u00fcresinin 45 saate kadar a\u015f\u0131lmas\u0131 durumunda ortaya \u00e7\u0131kar. Bu durumda i\u015f\u00e7i, fazla \u00e7al\u0131\u015ft\u0131\u011f\u0131 s\u00fcreler bak\u0131m\u0131ndan saatlik \u00fccretinin %25 fazlas\u0131 kadar \u00fccrete hak kazanacakt\u0131r.<\/p>\n\n\n\n<p>Fazla \u00e7al\u0131\u015fma ise haftal\u0131k ortalama \u00e7al\u0131\u015fma s\u00fcresinin 45 saat ya da alt\u0131nda belirlendi\u011fi durumlarda 45 saati a\u015fan \u00e7al\u0131\u015fmalar\u0131 ifade etmektedir. Bu durumda ise i\u015f\u00e7iye saatlik \u00fccretinin %50 fazlas\u0131, fazla \u00e7al\u0131\u015fma s\u00fcreleri bak\u0131m\u0131ndan \u00f6denmelidir.<\/p>\n\n\n\n<p>Fazla mesai alaca\u011f\u0131 davalar\u0131, k\u0131dem ya da ihbar tazminat\u0131 davalar\u0131 gibi i\u015f\u00e7inin en s\u0131k ba\u015fvurdu\u011fu davalardand\u0131r. \u0130\u015f\u00e7iler, tek bir dava ile bu alacaklar\u0131n tamam\u0131n\u0131 talep edebilir. Fazla mesai davalar\u0131 bak\u0131m\u0131ndan, fazla mesainin yap\u0131ld\u0131\u011f\u0131n\u0131n ispat\u0131 i\u015f\u00e7iye, kar\u015f\u0131l\u0131klar\u0131n\u0131n \u00f6dendi\u011finin ispat\u0131 ise i\u015fverene aittir. \u0130\u015f\u00e7i, fazla mesainin yap\u0131ld\u0131\u011f\u0131n\u0131 farkl\u0131 deliller ile ispat edebilir. Uygulamada fazla mesainin ger\u00e7ekle\u015fti\u011finin en s\u0131k ispat arac\u0131 tan\u0131klard\u0131r. Ortalama iki tan\u0131k ile i\u015f\u00e7i fazla mesailerin yap\u0131ld\u0131\u011f\u0131n\u0131 ispat edebilecektir. Tan\u0131klar\u0131n beyanlar\u0131, dava a\u00e7an i\u015f\u00e7i ile ayn\u0131 d\u00f6nemde \u00e7al\u0131\u015ft\u0131klar\u0131 d\u00f6nemlerle s\u0131n\u0131rl\u0131 olarak \u00f6nem arz etmektedir. \u00d6te yandan ayn\u0131 i\u015fverene kar\u015f\u0131 davas\u0131 bulunan ve devam eden tan\u0131klar\u0131n beyanlar\u0131n\u0131n fazla mesai ve ulusal bayram genel tatil alacaklar\u0131 bak\u0131m\u0131ndan itibar g\u00f6rmeyece\u011fi de Yarg\u0131tay uygulamalar\u0131 ile sabittir.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"aioseo-haftada-45-saat-uzeri-calisma-fazla-calismadir\">Haftada 45 Saat \u00dczeri \u00c7al\u0131\u015fma Fazla \u00c7al\u0131\u015fmad\u0131r<\/h3>\n\n\n\n<p>Fazla mesai bak\u0131m\u0131ndan \u015fu hususlar\u0131n da bilinmesinde yarar vard\u0131r; bir i\u015f\u00e7i bir g\u00fcnde en fazla 11 saat \u00e7al\u0131\u015ft\u0131r\u0131labilir. Ayr\u0131ca g\u00fcnde 11 saat a\u015f\u0131lmamak kayd\u0131yla 8 haftal\u0131k ortalama 45 saat olacak \u015fekilde i\u015f\u00e7iler \u00e7al\u0131\u015ft\u0131r\u0131labilir. Bu usule denkle\u015ftirme usul\u00fc denilmektedir.<\/p>\n\n\n\n<p>Fazla mesai \u00fccreti do\u011fru \u015fekilde hesap edilmeli ve \u00f6denmelidir. Aksi takdirde fazla mesai alaca\u011f\u0131n\u0131 alamayan i\u015f\u00e7i, a\u00e7aca\u011f\u0131 bir dava ile fazla mesai \u00fccretlerini talep edebilecektir. Hemen belirtmek gerekir ki fazla mesai alaca\u011f\u0131n\u0131n \u00f6denmemesi, i\u015f\u00e7iye i\u015f s\u00f6zle\u015fmesini fesih imkan\u0131 vermektedir. Zira Yarg\u0131tay, fazla mesai alacaklar\u0131n\u0131 geni\u015f anlamda \u00fccret ad\u0131 alt\u0131nda saymaktad\u0131r.<\/p>\n\n\n\n<p>Fazla mesai alaca\u011f\u0131 davalar\u0131 \u0130\u015f Mahkemelerinde a\u00e7\u0131lan davalardand\u0131r. Dava, i\u015fyerinin bulundu\u011fu merkezde ya da i\u015fin g\u00f6r\u00fcld\u00fc\u011f\u00fc yer mahkemesinde a\u00e7\u0131labilir. Fazla \u00e7al\u0131\u015fma davalar\u0131nda zamana\u015f\u0131m\u0131 5 y\u0131l olup, s\u00f6z konusu s\u00fcre, k\u0131dem ya da ihbar tazminat\u0131 alacaklar\u0131na ili\u015fkin zamana\u015f\u0131m\u0131 s\u00fcresinin tersine olarak geriye do\u011fru i\u015flemektedir.<\/p>\n\n\n\n<p>Fazla mesainin tespitinde \u00e7al\u0131\u015fma s\u00fcresinden say\u0131lan ya da say\u0131lmayan durumlar\u0131n da iyi bir \u015fekilde tespit edilmesi gerekmektedir. \u00d6rne\u011fin 7.5 saatin \u00fcst\u00fcndeki \u00e7al\u0131\u015fmalarda 60 dakika yemek molas\u0131 \u00e7al\u0131\u015fma s\u00fcresinden say\u0131lmayacakt\u0131r. Di\u011fer bir \u00f6rnek olarak i\u015f\u00e7inin i\u015fveren taraf\u0131ndan farkl\u0131 bir yerde \u00e7al\u0131\u015ft\u0131r\u0131lmas\u0131 durumunda yolda ge\u00e7en s\u00fcre ise \u00e7al\u0131\u015fma s\u00fcresinden say\u0131lacakt\u0131r.<\/p>\n\n\n\n<p>G\u00f6r\u00fcld\u00fc\u011f\u00fc \u00fczere fazla mesai davalar\u0131 bak\u0131m\u0131ndan \u00f6nemli \u015fekli hususlar s\u00f6z konusudur. Hakk\u0131n kaybolmamas\u0131 i\u00e7in s\u00f6z konusu hususlara \u00f6nem verilmeli, talepler zaman\u0131nda sunulmal\u0131 ve ger\u00e7ek durum hukuka uygun bir \u015fekilde ispat edilmelidir. \u00d6rne\u011fin ayn\u0131 i\u015fverene kar\u015f\u0131 davas\u0131 bulunan tan\u0131\u011f\u0131n dinlenilmesi durumunda, davac\u0131 i\u015f\u00e7i hakl\u0131 olsa da fazla mesai hususunu ispat edememi\u015f say\u0131lacakt\u0131r. Bu gibi durumlarla kar\u015f\u0131la\u015f\u0131lmamas\u0131, i\u015f\u00e7inin hukuk kurallar\u0131n\u0131 g\u00f6zetmesi ile m\u00fcmk\u00fcnd\u00fcr.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"aioseo-isci\">\u0130\u015f\u00e7i<\/h2>\n\n\n\n<p>\u0130\u015f Hukukuna ili\u015fkin d\u00fczenlemeler 4857 say\u0131l\u0131 \u0130\u015f Kanununda yer almakta olup, i\u015f\u00e7inin tan\u0131m\u0131 bu kanunun 2. Maddesinde yap\u0131lm\u0131\u015ft\u0131r. Buna g\u00f6re;&nbsp;<strong>bir i\u015f s\u00f6zle\u015fmesine dayanarak \u00e7al\u0131\u015fan ger\u00e7ek ki\u015fiye i\u015f\u00e7i denmektedir<\/strong>.<\/p>\n\n\n\n<p>Kanundaki tan\u0131ma g\u00f6re bir ki\u015finin \u0130\u015f Kanunu anlam\u0131nda i\u015f\u00e7i say\u0131labilmesi i\u00e7in; i\u015f s\u00f6zle\u015fmesine g\u00f6re \u00e7al\u0131\u015fmas\u0131 ve ayn\u0131 kanunun 4. maddesinde say\u0131lan (Deniz ve hava ta\u015f\u0131ma i\u015fleri, ev hizmetleri, \u00e7\u0131raklar, spor) istisnalar kapsam\u0131ndaki i\u015fleri yapm\u0131yor olmas\u0131 gerekmektedir. Bunun d\u0131\u015f\u0131nda kanunumuzda fikri \u00e7al\u0131\u015fma- bedeni \u00e7al\u0131\u015fma gibi hi\u00e7bir ayr\u0131m yap\u0131lmam\u0131\u015ft\u0131r. Sanayi sekt\u00f6r\u00fcnde, ticaret sekt\u00f6r\u00fcnde, hizmet sekt\u00f6r\u00fcnde veya kamu sekt\u00f6r\u00fcnde\u2026 \u00e7al\u0131\u015f\u0131p \u00e7al\u0131\u015fmad\u0131\u011f\u0131 fark etmeksizin, bir i\u015f s\u00f6zle\u015fmesi ile i\u015fverene ba\u011fl\u0131 olarak \u00e7al\u0131\u015fan herkes i\u015f\u00e7i olarak kabul edilmektedir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"aioseo-isveren\">\u0130\u015fveren<\/h2>\n\n\n\n<p>Kanundaki tan\u0131ma g\u00f6re;&nbsp;<strong>\u0130\u015f\u00e7i \u00e7al\u0131\u015ft\u0131ran ger\u00e7ek ki\u015fi veya t\u00fczel ki\u015filer ile t\u00fczel ki\u015fili\u011fi olmayan kurum ve kurulu\u015flar i\u015fveren say\u0131l\u0131r<\/strong>. Buna g\u00f6re ger\u00e7ek ki\u015filer (birey) i\u015fveren olabilece\u011fi gibi t\u00fczel ki\u015filer(\u015firket, dernek, sendika, devlet, \u00fcniversite, belediye \u2026) ve t\u00fczel ki\u015fili\u011fi olmayan kurum ve kurulu\u015flar da i\u015fveren olabilecektir. Bunun d\u0131\u015f\u0131nda kanunumuz i\u015fveren olmak i\u00e7in herhangi bir ko\u015ful veya \u015fart aramam\u0131\u015ft\u0131r.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"aioseo-is-sozlesmesi\">\u0130\u015f S\u00f6zle\u015fmesi<\/h2>\n\n\n\n<p>4857 say\u0131l\u0131 \u0130\u015f Kanununun 8. Maddesinde i\u015f s\u00f6zle\u015fmesinin tan\u0131m\u0131 yap\u0131lm\u0131\u015ft\u0131r. \u201c<strong>\u0130\u015f s\u00f6zle\u015fmesi, bir taraf\u0131n (i\u015f\u00e7i) ba\u011f\u0131ml\u0131 olarak i\u015f g\u00f6rmeyi, di\u011fer taraf\u0131n (i\u015fveren) da \u00fccret \u00f6demeyi \u00fcstlenmesinden olu\u015fan s\u00f6zle\u015fmedir<\/strong>.\u201d\u0130\u015f s\u00f6zle\u015fmesi, Kanunda aksi belirtilmedik\u00e7e, \u00f6zel bir \u015fekle t\u00e2bi de\u011fildir.\u201d<\/p>\n\n\n\n<p>Basit ifade ile i\u015f\u00e7inin i\u015f g\u00f6rmeyi, i\u015fverenin de \u00fccret \u00f6demeyi \u00fcstlendi\u011fi s\u00f6zle\u015fmelere i\u015f s\u00f6zle\u015fmesi denmektedir. Kanunumuzda bir\u00e7ok s\u00f6zle\u015fme t\u00fcr\u00fc d\u00fczenlenmi\u015ftir. Fesih iradesinin gerekli \u015fekilde ortaya koyulmamas\u0131, bir tak\u0131m sorumluluklar\u0131 beraberinde getirebilir. \u00d6rne\u011fin i\u015f\u00e7i, i\u015f s\u00f6zle\u015fmesini diledi\u011fi \u015fekilde sona erdirebilir. \u00d6rnek olarak i\u015f\u00e7i, yaz\u0131l\u0131 bir beyan ile i\u015f s\u00f6zle\u015fmesini hakl\u0131 nedenle ya da istifa ile sona erdirebilece\u011fi gibi, hi\u00e7bir bilgi ya da belge vermeden eylemli olarak (i\u015fyerinden \u00e7\u0131k\u0131p gelmeyerek) da sona erdirebilir.<\/p>\n\n\n\n<p>\u0130\u015fveren ise i\u015f\u00e7i kadar serbest de\u011fildir. \u0130\u015fveren \u00e7\u0131k\u0131\u015f nedenini, gerek\u00e7eli, ger\u00e7ek ve \u015fekil \u015fartlar\u0131na uygun bir \u015fekilde g\u00f6stermelidir. \u0130\u015fveren de tabii ki s\u00f6zle\u015fmeyi s\u00f6zle dahi sona erdirebilir. Bu hususlar kar\u0131\u015ft\u0131r\u0131lmamal\u0131d\u0131r. Fakat e\u011fer i\u015fveren herhangi bir fesih bildiriminde bulunmazsa ya da fesih herhangi bir gerek\u00e7eye dayanm\u0131yorsa, di\u011fer \u015fartlar\u0131 varsa i\u015fe i\u015f\u00e7i iade davas\u0131 a\u00e7\u0131p kazanabilecektir. Dolay\u0131s\u0131yla i\u015fveren fesih bak\u0131m\u0131ndan dikkatli bir \u015fekilde hareket etmelidir.<\/p>\n\n\n\n<p>\u0130\u015f akdinin feshi, i\u015f\u00e7i ya da i\u015fverenin alacaklar\u0131 ya da bor\u00e7lar\u0131 bak\u0131m\u0131ndan \u00f6nem arz etmektedir. \u0130\u015f s\u00f6zle\u015fmesini hakl\u0131 nedenle fesheden, kanunda say\u0131lan hallere dahil eden (\u00f6rne\u011fin kad\u0131n i\u015f\u00e7inin evlilikten 1 y\u0131l i\u00e7inde i\u015ften \u00e7\u0131kmas\u0131) ya da i\u015f s\u00f6zle\u015fmesi hakl\u0131 neden olmaks\u0131z\u0131n feshedilen i\u015f\u00e7i, ihtimallere ve di\u011fer \u015fartlar\u0131 ta\u015f\u0131mas\u0131na g\u00f6re i\u015fe iade davas\u0131 a\u00e7abilecek, ihbar ya da k\u0131dem tazminat\u0131 gibi \u00f6nemli kalemleri talep edebilecektir.<\/p>\n\n\n\n<p>Ayn\u0131 \u015fekilde i\u015fveren de s\u00f6z konusu davalar\u0131n \u00f6n\u00fcne ge\u00e7mek isterse, fesih bak\u0131m\u0131ndan gereken kurallara uymal\u0131d\u0131r.<\/p>\n\n\n\n<p>Her bir fesih hali, kendine \u00f6zg\u00fc \u00f6zellikler ta\u015f\u0131maktad\u0131r. \u00d6rne\u011fin i\u015fverenin hakl\u0131 nedenle feshinde i\u015f\u00e7inin savunmas\u0131 al\u0131nmayabilecek, ihbar s\u00fcresi g\u00f6zetilmeyebilecektir. Ya da i\u015f\u00e7i ya da i\u015fveren fark etmeksizin, hakl\u0131 nedenle fesih halinin olu\u015fmas\u0131ndan 6 i\u015f g\u00fcn\u00fc i\u00e7inde fesih hakk\u0131 kullan\u0131lmal\u0131d\u0131r. Bu tarih tam bir tarih olabilece\u011fi gibi bir projenin sonu da olabilir. \u0130\u015f Kanunu madde 11\u2019e g\u00f6re \u201cBelirli s\u00fcreli i\u015f s\u00f6zle\u015fmesi, esasl\u0131 bir neden olmad\u0131k\u00e7a, birden fazla \u00fcst \u00fcste (zincirleme) yap\u0131lamaz. Aksi halde i\u015f s\u00f6zle\u015fmesi ba\u015flang\u0131\u00e7tan itibaren belirsiz s\u00fcreli kabul edilir.\u201d<\/p>\n\n\n\n<p>Belirsiz s\u00fcreli i\u015f s\u00f6zle\u015fmesi ise s\u00f6zle\u015fmenin biti\u015f tarihinin \u00f6nceden bilinmedi\u011fi s\u00f6zle\u015fmelerdir.<\/p>\n\n\n\n<p>\u0130\u015f s\u00f6zle\u015fmeleri, i\u015f ili\u015fkisinde g\u00f6zetilecek kurallar\u0131 g\u00f6sterdi\u011finden \u00e7ok \u00f6nemlidir. Bu nedenle s\u00f6zle\u015fmelerin her bir i\u015f\u00e7iye \u00f6zel yap\u0131lmas\u0131nda, kurallar\u0131n a\u00e7\u0131k, net ve tart\u0131\u015fmaya yer vermeyecek \u015fekilde ortaya koyulmas\u0131nda yarar vard\u0131r.<\/p>\n\n\n\n<p>\u00d6nemli olarak k\u0131dem ve ihbar tazminat\u0131 ile i\u015fe iade hakk\u0131, s\u00f6zle\u015fmenin niteli\u011fine g\u00f6re de\u011fi\u015fmektedir. K\u0131dem tazminat\u0131 hakk\u0131, \u015fartlar mevcutsa hem belirli, hem de belirsiz s\u00fcreli s\u00f6zle\u015fmeler bak\u0131m\u0131ndan m\u00fcmk\u00fcnd\u00fcr. \u0130hbar tazminat\u0131 ile i\u015fe iade hakk\u0131 ise belirsiz s\u00fcreli s\u00f6zle\u015fmeler bak\u0131m\u0131ndan \u015fartlar\u0131 varsa m\u00fcmk\u00fcn iken, belirli s\u00fcreli i\u015f s\u00f6zle\u015fmeleri bak\u0131m\u0131ndan m\u00fcmk\u00fcn de\u011fildir.<\/p>\n\n\n\n<p>\u0130\u015f s\u00f6zle\u015fmelerinde genellikle \u015fu hususlar bulunur:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>S\u00f6zle\u015fme tarihi (imza tarihi)<\/li>\n\n\n\n<li>Taraflar\u0131n tam isimleri ve bilgileri (resmi makamlara bilgi verilmektedir)<\/li>\n\n\n\n<li>\u00dccret ve \u00f6deme tarihi<\/li>\n\n\n\n<li>G\u00f6rev tan\u0131m\u0131<\/li>\n\n\n\n<li>S\u00f6zle\u015fmenin belirli ya da belirsiz s\u00fcreli oldu\u011fu<\/li>\n\n\n\n<li>Taraflar\u0131n hak ve y\u00fck\u00fcml\u00fcl\u00fckleri<\/li>\n\n\n\n<li>\u00c7al\u0131\u015fma s\u00fcreleri<\/li>\n\n\n\n<li>Fesih halleri<\/li>\n\n\n\n<li>Tercihen rekabet yasa\u011f\u0131, cezai \u015fart, gizlilik gibi ihtimaller<\/li>\n<\/ul>\n\n\n\n<p>Bu hususlar s\u0131n\u0131rl\u0131 say\u0131da de\u011fildir. Kurallara ayk\u0131r\u0131l\u0131k te\u015fkil etmeyecek \u015fekilde bu maddeler \u00e7o\u011falt\u0131labilir.<\/p>\n\n\n\n<p>Yukar\u0131da da belirtildi\u011fi \u00fczere i\u015f s\u00f6zle\u015fmesinin her bir i\u015f\u00e7i bak\u0131m\u0131ndan ayr\u0131ca g\u00f6zden ge\u00e7irilmesinde fayda vard\u0131r. Bunun d\u0131\u015f\u0131nda i\u015f s\u00f6zle\u015fmeleri titizlikle olu\u015fturulmal\u0131d\u0131r. Zira uygulamada ne yaz\u0131k ki bir\u00e7ok taraf, s\u00f6zle\u015fmeyi okumadan s\u00f6zle\u015fmeye imza atmaktad\u0131r ve akabinde s\u0131k\u0131nt\u0131ya d\u00fc\u015fmektedir. \u00d6zellikle i\u015f\u00e7iler metni iyi okumal\u0131, gerekirse bir avukata dan\u0131\u015fmal\u0131, anla\u015fmad\u0131\u011f\u0131 ya da sebebini bilmedi\u011fi yerleri i\u015fverene bildirmelidir. S\u00f6zle\u015fmeden mutlaka bir n\u00fcsha da kendine almal\u0131d\u0131r.<\/p>\n\n\n\n<p>Uygulamada kar\u015f\u0131la\u015f\u0131lan s\u0131k\u0131nt\u0131lardan biri de yine ayn\u0131 durumdan kaynaklanmaktad\u0131r. G\u00f6rev tan\u0131m\u0131n\u0131n yaz\u0131lmamas\u0131 ya da geni\u015f tutulmas\u0131 durumunda i\u015f\u00e7i bir\u00e7ok y\u00fck\u00fcml\u00fcl\u00fckten sorumlu olmaktad\u0131r.
