Uzman avukatlar\u0131m\u0131z; kentsel d\u00f6n\u00fc\u015f\u00fcm hukuku, tapu iptal ve tescil davas\u0131, ortakl\u0131\u011f\u0131n giderilmesi davas\u0131, ecrimisil, el atman\u0131n \u00f6nlenmesi ve kira davalar\u0131nda avukatl\u0131k hizmeti vermektedir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Ecrimisil Davas\u0131 Avukat\u0131 (Haks\u0131z \u0130\u015fgal Tazminat\u0131)<\/h2>\n\n\n\n<p>Ecrimisil; bir e\u015fyan\u0131n, sahibinin r\u0131zas\u0131 bulunmaks\u0131z\u0131n, onun \u00fczerinde tasarrufta bulunma yetkisine sahip olmayan k\u00f6t\u00fcniyetli 3. ki\u015fi taraf\u0131ndan kullan\u0131lmas\u0131ndan dolay\u0131 olu\u015fan zarara kar\u015f\u0131l\u0131k olmak \u00fczere verilen tazminat olarak nitelenen \u00f6zel giderim bi\u00e7imidir. Ecrimisil davas\u0131 da; mal\u0131 haks\u0131z ve k\u00f6t\u00fc niyetli olarak kullanan ve geri verme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn\u00fc yerine getirmeyen ki\u015filerden haks\u0131z i\u015fgal tazminat\u0131n\u0131n al\u0131n\u0131p, bu e\u015fyan\u0131n sahibine geri verilmesini ama\u00e7layan bir dava t\u00fcr\u00fcd\u00fcr.<\/p>\n\n\n\n<p>Ecrimisil san\u0131lan\u0131n aksine kira alaca\u011f\u0131 de\u011fildir.&nbsp;<strong>Kirada, kirac\u0131 ile kiraya verenin hukuka uygun olarak kar\u015f\u0131l\u0131kl\u0131 irade a\u00e7\u0131klamalar\u0131 s\u00f6z konusu iken; ecrimisilde hukuka uygun bir irade a\u00e7\u0131klamas\u0131 yoktur.<\/strong>&nbsp;K\u00f6t\u00fcniyetli olan 3. ki\u015finin, ba\u015fkas\u0131na ait oldu\u011funu bildi\u011fi bir gayrimenkulu, malikin veya zilyedin r\u0131zas\u0131 olmaks\u0131z\u0131n, sanki kendi mal\u0131ym\u0131\u015f gibi kullanmas\u0131, kiraya vermesi, kiralar\u0131 toplamas\u0131 hali s\u00f6z konusudur.<\/p>\n\n\n\n<p>Ecrimisil 4721 say\u0131l\u0131 T\u00fcrk Medeni Kanunu\u2019nun 995. Maddesinde d\u00fczenlenmi\u015ftir.<\/p>\n\n\n\n<p><strong>MADDE 995.-&nbsp;<\/strong><em>\u0130yiniyetli olmayan zilyet, geri vermekle y\u00fck\u00fcml\u00fc oldu\u011fu \u015feyi haks\u0131z al\u0131koymu\u015f olmas\u0131 y\u00fcz\u00fcnden hak sahibine verdi\u011fi zararlar ve elde etti\u011fi veya elde etmeyi ihmal eyledi\u011fi \u00fcr\u00fcnler kar\u015f\u0131l\u0131\u011f\u0131nda tazminat \u00f6demek zorundad\u0131r.<\/em><\/p>\n\n\n\n<p>Haks\u0131z \u0130\u015fgalciden Ecrimisil isteyebilmek i\u00e7in olu\u015fmas\u0131 gereken baz\u0131 ko\u015fullar s\u00f6z konusudur;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Haks\u0131z i\u015fgal olmal\u0131d\u0131r<\/h2>\n\n\n\n<p>Bu \u015fart bir\u00e7ok \u015fekilde ger\u00e7ekle\u015febilmektedir. Kiraya verilmi\u015f ta\u015f\u0131nmazda kira s\u00f6zle\u015fmesinin sona ermi\u015f olmas\u0131na ra\u011fmen s\u00f6zle\u015fmeyi yenilemeden kullan\u0131m\u0131n s\u00fcrd\u00fcr\u00fclmesi hali, hen\u00fcz intikali ger\u00e7ekle\u015fmemi\u015f ta\u015f\u0131nmaz\u0131n miras\u00e7\u0131larca kullan\u0131lmas\u0131 hali, izinsiz in\u015faat yap\u0131lmas\u0131, gayrimenkul\u00fcn kendi mal\u0131ym\u0131\u015f gibi kiraya verilip kira bedelinin toplanmas\u0131 hali \u00f6rnek olarak verilebilir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">\u0130ntifadan Men \u015fart\u0131<\/h2>\n\n\n\n<p>Payda\u015flar kural olarak intifadan men edilmedik\u00e7e birbirinden ecrimisil isteyemeyeceklerinden, intifadan men ko\u015fulunun ger\u00e7ekle\u015fmesi de; ecrimisil istenen s\u00fcreden \u00f6nce davac\u0131 payda\u015f\u0131n davaya konu ta\u015f\u0131nmazdan ya da gelirinden yararlanmak iste\u011finin daval\u0131 payda\u015fa bildirilmi\u015f olmas\u0131na ba\u011fl\u0131 oldu\u011fundan ayr\u0131ca intifadan men ko\u015fulunun ger\u00e7ekle\u015fti\u011fine y\u00f6nelik iddia yemin d\u00e2hil her t\u00fcrl\u00fc delille kan\u0131tlanabilir nitelikte oldu\u011fundan bu kural\u0131n bir tak\u0131m istisnalar\u0131 diyebilece\u011fimiz durumlar uygulamada kar\u015f\u0131m\u0131za \u00e7\u0131kmaktad\u0131r. Ba\u011f, bah\u00e7e, i\u015fyeri gibi do\u011fal \u00fcr\u00fcn veren bir nitelik ta\u015f\u0131mas\u0131, kiraya verilerek hukuksal semere elde edilen yerlerden olmas\u0131, payl\u0131 ta\u015f\u0131nmaz\u0131 i\u015fgal eden payda\u015f\u0131n bu yerin tamam\u0131nda hak iddias\u0131 ve di\u011ferlerinin payda\u015fl\u0131\u011f\u0131n\u0131 ink\u00e2r etmesi, payda\u015flar aras\u0131nda yap\u0131lan kullan\u0131m anla\u015fma sonucu her payda\u015f\u0131n yararlanaca\u011f\u0131 ortak ta\u015f\u0131nmaz veya b\u00f6l\u00fcmlerinin belirli bulunmas\u0131, durumlar\u0131 da intifadan men kural\u0131n\u0131n istisnalar\u0131 olarak yerle\u015fik i\u00e7tihatlarda kar\u015f\u0131m\u0131za \u00e7\u0131kmaktad\u0131r.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Haks\u0131z i\u015fgalden dolay\u0131, malik veya zilyedin zarara u\u011framas\u0131<\/h2>\n\n\n\n<p>E\u015fyan\u0131n sahibinin mahrum kald\u0131\u011f\u0131 kar nedeni ile u\u011fram\u0131\u015f oldu\u011fu zararlar veya e\u015fyan\u0131n kullan\u0131m\u0131 nedeni ile y\u0131pranmadan dolay\u0131 olu\u015fan zararlar bu kapsama girmektedir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">E\u015fyay\u0131 elinde bulunduran ki\u015finin k\u00f6t\u00fcniyetli olmas\u0131<\/h2>\n\n\n\n<p>Kullanm\u0131\u015f oldu\u011fu e\u015fyan\u0131n ba\u015fkas\u0131na ait oldu\u011funu bilmesi ya da bilebilecek durumda olmas\u0131 gerekmektedir. \u0130ntifadan men ko\u015fulunun ger\u00e7ekle\u015fmesinden sonra art\u0131k iyi niyetten bahsedilemeyecektir.<\/p>\n\n\n\n<p><strong>K\u00f6t\u00fcniyetli zilyedin elde etti\u011fi veya elde etmeyi ihmal etti\u011fi semereler olmal\u0131d\u0131r.<\/strong><\/p>\n\n\n\n<p>Haks\u0131z i\u015fgal tazminat\u0131 talebine ba\u011fl\u0131 olarak a\u00e7\u0131lacak ecrimisil davalar\u0131 5 y\u0131ll\u0131k zamana\u015f\u0131m\u0131 s\u00fcresine tabidir. Ayr\u0131ca ecrimisil talebine konu tazminat, sahip oldu\u011fu nitelik itibariyle ge\u00e7mi\u015fe d\u00f6n\u00fck olarak talep edilebilmektedir.<\/p>\n\n\n\n<p>Ecrimisil davalar\u0131 Asliye Hukuk Mahkemelerinde g\u00f6r\u00fclmekte olup, haks\u0131z i\u015fgale u\u011frayan \u015fey ta\u015f\u0131nmaz ise ta\u015f\u0131nmaz\u0131n bulundu\u011fu yer mahkemeleri yetkili olacakt\u0131r. Bu davalar ecrimisile konu haks\u0131z fiilin \u00f6nlenmesi yani m\u00fcdahalenin men\u2019i davas\u0131 veya tapu iptal davalar\u0131 ile birlikte a\u00e7\u0131labilece\u011fi gibi, bu davalardan ba\u011f\u0131ms\u0131z olarak da a\u00e7\u0131labilmektedir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">En S\u0131k Kar\u015f\u0131la\u015f\u0131lan Gayrimenkul Davalar\u0131;<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\"><strong><a href=\"https:\/\/turkeylegal.com.tr\/tr\/ortakligin-giderilmesi-davasi-avukati\">Ortakl\u0131\u011f\u0131n Giderilmesi Davas\u0131<\/a><\/strong><\/h3>\n\n\n\n<p>Ki\u015filerin payl\u0131 m\u00fclkiyet ya da elbirli\u011fi ile m\u00fclkiyetine tabi ta\u015f\u0131nmaz mallar\u0131 \u00fczerindeki ortakl\u0131\u011f\u0131n sona erdirilmesine ili\u015fkin dava t\u00fcr\u00fcne Ortakl\u0131\u011f\u0131n Giderilmesi Davas\u0131 denmektedir. Bu davada h\u00e2kim \u00f6ncelikli olarak ta\u015f\u0131nmaz\u0131n aynen taksimi suretiyle ortakl\u0131\u011f\u0131n giderilmesini sa\u011flamaya \u00e7al\u0131\u015facak, bunun m\u00fcmk\u00fcn olmamas\u0131 durumunda da ortakl\u0131\u011f\u0131n sat\u0131\u015f sureti ile giderilmesini h\u00fck\u00fcm alt\u0131na alacakt\u0131r.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong><a href=\"https:\/\/turkeylegal.com.tr\/tr\/tapu-iptal-ve-tescil-davasi-avukati\">Tapu \u0130ptal ve Tescil Davas\u0131<\/a><\/strong><\/h3>\n\n\n\n<p>Kanuna ayk\u0131r\u0131 olarak; usuls\u00fcz veya hatal\u0131 bir \u015fekilde yap\u0131ld\u0131\u011f\u0131 iddia edilen tapu kay\u0131tlar\u0131n\u0131n d\u00fczeltilmesi i\u00e7in a\u00e7\u0131lan dava t\u00fcr\u00fcne denmektedir. Bu dava genellikle; tapu kayd\u0131n\u0131n yap\u0131ld\u0131\u011f\u0131 anda hukuki ehliyetin bulunmamas\u0131, muris muvazas\u0131 (mirastan mal ka\u00e7\u0131rma) durumunun bulunmas\u0131, ta\u015f\u0131nmaz\u0131n aile konutu olmas\u0131\u2026 gibi sebepler nedeniyle a\u00e7\u0131lmaktad\u0131r.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Arsa Pay\u0131 D\u00fczeltim Davalar\u0131<\/h3>\n\n\n\n<p>Bir gayrimenkul\u00fcn kat irtifak\u0131 veya kat m\u00fclkiyeti kurulurken ana yap\u0131n\u0131n bulundu\u011fu parsel arsas\u0131ndan de\u011ferleme oran\u0131nda arsadan verilen paya arsa pay\u0131 denmektedir. Arsa paylar\u0131, ki\u015filerin sahip olduklar\u0131 ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerin paylar\u0131 ile orant\u0131l\u0131 olarak tahsis edilmedi\u011fi hallerde, her kat sahibi arsa pay\u0131n\u0131n d\u00fczenlenmesi i\u00e7in bu davay\u0131 a\u00e7abilecektir.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong><a href=\"https:\/\/turkeylegal.com.tr\/tr\/Kira-Tespit-Davasi-Avukati\">Kira Bedelinin Tespiti Davalar\u0131<\/a><\/strong><\/h3>\n\n\n\n<p>Kira s\u00f6zle\u015fmeleri; kirac\u0131 ile kiraya veren aras\u0131nda kar\u015f\u0131l\u0131kl\u0131 irade beyan\u0131na dayal\u0131 olarak yap\u0131lan s\u00f6zle\u015fmelerdir. Bu s\u00f6zle\u015fmelerin yap\u0131labilmesi i\u00e7in taraflar\u0131n kira bedelinin belirlenmesi noktas\u0131nda kar\u015f\u0131l\u0131kl\u0131 muvafakate varm\u0131\u015f olmalar\u0131 gerekmektedir. G\u00fcn\u00fcm\u00fczde ta\u015f\u0131nmaz sahipleri kira s\u00f6zle\u015fmesinin yenilenmesi durumunda mevcut kiraya belirli oranlarda zam yapmaktad\u0131rlar. \u0130\u015fte kira bedelinin belirlenmesi a\u015famas\u0131nda taraflar aras\u0131nda uyu\u015fmazl\u0131k \u00e7\u0131kmas\u0131 durumunda, bedelin; hakim taraf\u0131ndan emsal kira bedellerine ve hakkaniyete uygun \u015fekilde belirlenmesi i\u00e7in a\u00e7\u0131lan davaya Kira Bedelinin Tespiti Davas\u0131 denir.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong><a href=\"https:\/\/turkeylegal.com.tr\/tr\/Ihtiyac-Nedeniyle-Kiracinin-Tahliyesi\">Kirac\u0131n\u0131n Tahliyesi Davalar\u0131<\/a><\/strong><\/h3>\n\n\n\n<p>Bir ta\u015f\u0131nmazdaki kirac\u0131n\u0131n tahliyesinin istenmesi durumunda kiraya veren bunu iki \u015fekilde ger\u00e7ekle\u015ftirebilmektedir. Bunlar: bildirim yolu ve tahliye davas\u0131 a\u00e7ma yoludur. Tahliye davas\u0131, kira s\u00f6zle\u015fmesinin mahkeme karar\u0131 ile sonland\u0131r\u0131lmas\u0131na y\u00f6nelik olarak a\u00e7\u0131lan bir dava t\u00fcr\u00fcd\u00fcr. Bu davan\u0131n a\u00e7\u0131labilmesini kanun koyucu \u00e7e\u015fitli sebeplerin varl\u0131\u011f\u0131na ba\u011flam\u0131\u015ft\u0131r. Bu sebeplerden baz\u0131lar\u0131 kiraya verenden kaynaklanmaktayken (kiraya verenin ihtiyac\u0131, yeni malikin ihtiyac\u0131\u2026), baz\u0131lar\u0131 kirac\u0131dan kaynaklanmaktad\u0131r (hakl\u0131 sebeple kirac\u0131ya verilen 2 ihtar nedeni ile, kirac\u0131n\u0131n kendi konutunun ulunmas\u0131 nedeni ile). Bu dava kiraya veren taraf\u0131ndan Sulh Hukuk Mahkemelerinde a\u00e7\u0131labilmektedir.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong><a href=\"https:\/\/turkeylegal.com.tr\/tr\/ecrimisil-davasi-avukati\">Ecrimisil Davas\u0131<\/a><\/strong><\/h3>\n\n\n\n<p>Davac\u0131n\u0131n maliki oldu\u011fu ta\u015f\u0131nmaza haks\u0131z ve k\u00f6t\u00fc niyetli bir \u015fekilde el atan, onu kullanan ve bu suretle davac\u0131n\u0131n (malikin) m\u00fclkiyet hakk\u0131ndan kaynaklanan yararlar\u0131 elde etmesini engelleyen ki\u015fiye kar\u015f\u0131 a\u00e7\u0131lan dava t\u00fcr\u00fcne Ecrimisil Davas\u0131 denmektedir.
