Uzman avukatlar\u0131m\u0131z; kentsel d\u00f6n\u00fc\u015f\u00fcm hukuku, tapu iptal ve tescil davas\u0131, ortakl\u0131\u011f\u0131n giderilmesi davas\u0131, ecrimisil, el atman\u0131n \u00f6nlenmesi ve kira davalar\u0131nda avukatl\u0131k hizmeti vermektedir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Ortakl\u0131\u011f\u0131n Giderilmesi Davas\u0131 Avukat\u0131<\/h2>\n\n\n\n<p>T\u00fcrk Medeni Kanunu\u2019nun 642. maddesine g\u00f6re miras\u00e7\u0131lardan her biri her zaman miras\u0131n payla\u015f\u0131lmas\u0131n\u0131 isteyebilir. Her miras\u00e7\u0131, terekedeki belirli mallar\u0131n aynen, olanak yoksa sat\u0131\u015f yoluyla payla\u015ft\u0131r\u0131lmas\u0131na karar verilmesini sulh mahkemesinden isteyebilir. Miras\u00e7\u0131lardan birinin istemi \u00fczerine h\u00e2kim, terekenin tamam\u0131n\u0131 ve terekedeki mallar\u0131n her birini g\u00f6z \u00f6n\u00fcnde tutarak, olanak varsa ta\u015f\u0131nmazlardan her birinin tamam\u0131n\u0131n bir miras\u00e7\u0131ya verilmesi suretiyle payla\u015ft\u0131rmay\u0131 yapar. Miras\u00e7\u0131lara verilen ta\u015f\u0131nmazlar\u0131n de\u011ferleri aras\u0131ndaki fark para \u00f6denmesi yoluyla giderilerek miras paylar\u0131 aras\u0131nda denkle\u015ftirme sa\u011flan\u0131r.<\/p>\n\n\n\n<p>Sat\u0131\u015f iste\u011finin bulunup bulunmad\u0131\u011f\u0131 da g\u00f6z \u00f6n\u00fcnde tutulacakt\u0131r. E\u011fer sat\u0131\u015f iste\u011fi yoksa, sat\u0131\u015f suretiyle payda\u015fl\u0131\u011f\u0131n giderilmesine gidilemeyecektir.<\/p>\n\n\n\n<p>B\u00f6lme istemi durum ve ko\u015fullara uygun g\u00f6r\u00fclmezse ve \u00f6zellikle payl\u0131 mal\u0131n \u00f6nemli bir de\u011fer kayb\u0131na u\u011framadan b\u00f6l\u00fcnmesine olanak yoksa, a\u00e7\u0131k art\u0131rmayla sat\u0131\u015fa h\u00fckmolunur. Sat\u0131\u015f\u0131n payda\u015flar aras\u0131nda art\u0131rmayla yap\u0131lmas\u0131na karar verilmesi, b\u00fct\u00fcn payda\u015flar\u0131n r\u0131zas\u0131na ba\u011fl\u0131d\u0131r.<\/p>\n\n\n\n<p>Tapuda kay\u0131tl\u0131 olmayan ta\u015f\u0131nmaz mallarda ortakl\u0131\u011f\u0131n giderilmesi dava yolu ile istenemeyecektir. Ayr\u0131ca ortakl\u0131\u011f\u0131n giderilmesi ta\u015f\u0131nmaz\u0131n tamam\u0131 i\u00e7in s\u00f6z konusu olacakt\u0131r. Belirli bir pay\u0131n ortakl\u0131\u011f\u0131n\u0131n giderilmesi m\u00fcmk\u00fcn de\u011fildir.<\/p>\n\n\n\n<p>Elbirli\u011fi ile m\u00fclkiyetin payl\u0131 m\u00fclkiyete d\u00f6n\u00fc\u015ft\u00fcr\u00fclmesi de m\u00fcmk\u00fcnd\u00fcr. Bir miras\u00e7\u0131, terekeye dahil mallar\u0131n tamam\u0131 veya bir k\u0131sm\u0131 \u00fczerindeki elbirli\u011fi m\u00fclkiyetinin payl\u0131 m\u00fclkiyete d\u00f6n\u00fc\u015ft\u00fcr\u00fclmesi isteminde bulundu\u011fu takdirde sulh h\u00e2kimi, di\u011fer miras\u00e7\u0131lara \u00e7a\u011fr\u0131da bulunarak belirleyece\u011fi s\u00fcre i\u00e7inde varsa itirazlar\u0131n\u0131 bildirmeye davet eder. Elbirli\u011fi m\u00fclkiyetinin devam\u0131n\u0131 hakl\u0131 k\u0131lacak bir itiraz ileri s\u00fcr\u00fclmedi\u011fi veya miras\u00e7\u0131lardan biri belirlenen s\u00fcre i\u00e7inde payla\u015fma davas\u0131 a\u00e7mad\u0131\u011f\u0131 takdirde, istem konusu mal \u00fczerindeki elbirli\u011fi m\u00fclkiyetinin payl\u0131 m\u00fclkiyete d\u00f6n\u00fc\u015ft\u00fcr\u00fclmesine karar verilir.<\/p>\n\n\n\n<p>Muris ad\u0131na tapuda kay\u0131tl\u0131 ta\u015f\u0131nmaz mal\u0131n, miras\u00e7\u0131lar aras\u0131nda ortakl\u0131\u011f\u0131n giderilmesi i\u00e7in tapuda intikal muamelesinin yap\u0131lmas\u0131 \u015fart de\u011fildir. \u0130braz edilecek veraset ilam\u0131na g\u00f6re intikal muamelesi yap\u0131lmadan da ortakl\u0131\u011f\u0131n giderilmesine karar verilebilir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Ortakl\u0131\u011f\u0131n Giderilmesi Davalar\u0131 Nas\u0131l A\u00e7\u0131l\u0131r?<\/h2>\n\n\n\n<p>Miras\u00e7\u0131lar aralar\u0131n imzalayacaklar\u0131 bir miras taksim s\u00f6zle\u015fmesi ile payl\u0131 yahut elbirli\u011fi ile m\u00fclkiyete tabii ta\u015f\u0131n\u0131r ve ta\u015f\u0131nmaz mallara \u00fczerindeki ortakl\u0131\u011f\u0131n giderilmesini sa\u011flayabilirler. Ancak bu durumun m\u00fcmk\u00fcn olmad\u0131\u011f\u0131 takdirde ortakl\u0131\u011f\u0131n sona erdirilmesine ili\u015fkin olarak dava edilmesi yoluyla ortakl\u0131\u011f\u0131n giderilmesi m\u00fcmk\u00fcnd\u00fcr.<\/p>\n\n\n\n<p>Ortakl\u0131\u011f\u0131n giderilmesi davas\u0131, ortak olan t\u00fcm payda\u015flara kar\u015f\u0131 ta\u015f\u0131nmaz\u0131n bulundu\u011fu il veya il\u00e7edeki Sulh Hukuk Mahkemesinde a\u00e7\u0131l\u0131r. T\u00fcm payda\u015flar\u0131n ortakl\u0131\u011f\u0131n giderilmesi davas\u0131nda yer almas\u0131 zorunludur. Payda\u015flar\u0131n birinin vefat\u0131 halinde miras\u00e7\u0131l\u0131k belgesinde ismi ge\u00e7en t\u00fcm miras\u00e7\u0131lar\u0131n davaya dahil edilmesi gerekmektedir. Bu davalarda t\u00fcm ortaklar davaya dahil edilmeksizin davan\u0131n sonu\u00e7lanmas\u0131 m\u00fcmk\u00fcn de\u011fildir. Payda\u015flardan birinin miras\u00e7\u0131 b\u0131rakmaks\u0131z\u0131n \u00f6ld\u00fc\u011f\u00fc belirlendi\u011fi takdirde son miras\u00e7\u0131n\u0131n Hazine olaca\u011f\u0131 d\u00fc\u015f\u00fcn\u00fclmelidir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">En S\u0131k Kar\u015f\u0131la\u015f\u0131lan Gayrimenkul Davalar\u0131;<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\"><strong><a href=\"https:\/\/turkeylegal.com.tr\/tr\/ortakligin-giderilmesi-davasi-avukati\">Ortakl\u0131\u011f\u0131n Giderilmesi Davas\u0131<\/a><\/strong><\/h3>\n\n\n\n<p>Ki\u015filerin payl\u0131 m\u00fclkiyet ya da elbirli\u011fi ile m\u00fclkiyetine tabi ta\u015f\u0131nmaz mallar\u0131 \u00fczerindeki ortakl\u0131\u011f\u0131n sona erdirilmesine ili\u015fkin dava t\u00fcr\u00fcne Ortakl\u0131\u011f\u0131n Giderilmesi Davas\u0131 denmektedir. Bu davada h\u00e2kim \u00f6ncelikli olarak ta\u015f\u0131nmaz\u0131n aynen taksimi suretiyle ortakl\u0131\u011f\u0131n giderilmesini sa\u011flamaya \u00e7al\u0131\u015facak, bunun m\u00fcmk\u00fcn olmamas\u0131 durumunda da ortakl\u0131\u011f\u0131n sat\u0131\u015f sureti ile giderilmesini h\u00fck\u00fcm alt\u0131na alacakt\u0131r.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong><a href=\"https:\/\/turkeylegal.com.tr\/tr\/tapu-iptal-ve-tescil-davasi-avukati\">Tapu \u0130ptal ve Tescil Davas\u0131<\/a><\/strong><\/h3>\n\n\n\n<p>Kanuna ayk\u0131r\u0131 olarak; usuls\u00fcz veya hatal\u0131 bir \u015fekilde yap\u0131ld\u0131\u011f\u0131 iddia edilen tapu kay\u0131tlar\u0131n\u0131n d\u00fczeltilmesi i\u00e7in a\u00e7\u0131lan dava t\u00fcr\u00fcne denmektedir. Bu dava genellikle; tapu kayd\u0131n\u0131n yap\u0131ld\u0131\u011f\u0131 anda hukuki ehliyetin bulunmamas\u0131, muris muvazas\u0131 (mirastan mal ka\u00e7\u0131rma) durumunun bulunmas\u0131, ta\u015f\u0131nmaz\u0131n aile konutu olmas\u0131\u2026 gibi sebepler nedeniyle a\u00e7\u0131lmaktad\u0131r.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Arsa Pay\u0131 D\u00fczeltim Davalar\u0131<\/h3>\n\n\n\n<p>Bir gayrimenkul\u00fcn kat irtifak\u0131 veya kat m\u00fclkiyeti kurulurken ana yap\u0131n\u0131n bulundu\u011fu parsel arsas\u0131ndan de\u011ferleme oran\u0131nda arsadan verilen paya arsa pay\u0131 denmektedir. Arsa paylar\u0131, ki\u015filerin sahip olduklar\u0131 ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerin paylar\u0131 ile orant\u0131l\u0131 olarak tahsis edilmedi\u011fi hallerde, her kat sahibi arsa pay\u0131n\u0131n d\u00fczenlenmesi i\u00e7in bu davay\u0131 a\u00e7abilecektir.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong><a href=\"https:\/\/turkeylegal.com.tr\/tr\/Kira-Tespit-Davasi-Avukati\">Kira Bedelinin Tespiti Davalar\u0131<\/a><\/strong><\/h3>\n\n\n\n<p>Kira s\u00f6zle\u015fmeleri; kirac\u0131 ile kiraya veren aras\u0131nda kar\u015f\u0131l\u0131kl\u0131 irade beyan\u0131na dayal\u0131 olarak yap\u0131lan s\u00f6zle\u015fmelerdir. Bu s\u00f6zle\u015fmelerin yap\u0131labilmesi i\u00e7in taraflar\u0131n kira bedelinin belirlenmesi noktas\u0131nda kar\u015f\u0131l\u0131kl\u0131 muvafakate varm\u0131\u015f olmalar\u0131 gerekmektedir. G\u00fcn\u00fcm\u00fczde ta\u015f\u0131nmaz sahipleri kira s\u00f6zle\u015fmesinin yenilenmesi durumunda mevcut kiraya belirli oranlarda zam yapmaktad\u0131rlar. \u0130\u015fte kira bedelinin belirlenmesi a\u015famas\u0131nda taraflar aras\u0131nda uyu\u015fmazl\u0131k \u00e7\u0131kmas\u0131 durumunda, bedelin; hakim taraf\u0131ndan emsal kira bedellerine ve hakkaniyete uygun \u015fekilde belirlenmesi i\u00e7in a\u00e7\u0131lan davaya Kira Bedelinin Tespiti Davas\u0131 denir.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong><a href=\"https:\/\/turkeylegal.com.tr\/tr\/Ihtiyac-Nedeniyle-Kiracinin-Tahliyesi\">Kirac\u0131n\u0131n Tahliyesi Davalar\u0131<\/a><\/strong><\/h3>\n\n\n\n<p>Bir ta\u015f\u0131nmazdaki kirac\u0131n\u0131n tahliyesinin istenmesi durumunda kiraya veren bunu iki \u015fekilde ger\u00e7ekle\u015ftirebilmektedir. Bunlar: bildirim yolu ve tahliye davas\u0131 a\u00e7ma yoludur. Tahliye davas\u0131, kira s\u00f6zle\u015fmesinin mahkeme karar\u0131 ile sonland\u0131r\u0131lmas\u0131na y\u00f6nelik olarak a\u00e7\u0131lan bir dava t\u00fcr\u00fcd\u00fcr. Bu davan\u0131n a\u00e7\u0131labilmesini kanun koyucu \u00e7e\u015fitli sebeplerin varl\u0131\u011f\u0131na ba\u011flam\u0131\u015ft\u0131r. Bu sebeplerden baz\u0131lar\u0131 kiraya verenden kaynaklanmaktayken (kiraya verenin ihtiyac\u0131, yeni malikin ihtiyac\u0131\u2026), baz\u0131lar\u0131 kirac\u0131dan kaynaklanmaktad\u0131r (hakl\u0131 sebeple kirac\u0131ya verilen 2 ihtar nedeni ile, kirac\u0131n\u0131n kendi konutunun ulunmas\u0131 nedeni ile). Bu dava kiraya veren taraf\u0131ndan Sulh Hukuk Mahkemelerinde a\u00e7\u0131labilmektedir.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong><a href=\"https:\/\/turkeylegal.com.tr\/tr\/ecrimisil-davasi-avukati\">Ecrimisil Davas\u0131<\/a><\/strong><\/h3>\n\n\n\n<p>Davac\u0131n\u0131n maliki oldu\u011fu ta\u015f\u0131nmaza haks\u0131z ve k\u00f6t\u00fc niyetli bir \u015fekilde el atan, onu kullanan ve bu suretle davac\u0131n\u0131n (malikin) m\u00fclkiyet hakk\u0131ndan kaynaklanan yararlar\u0131 elde etmesini engelleyen ki\u015fiye kar\u015f\u0131 a\u00e7\u0131lan dava t\u00fcr\u00fcne Ecrimisil Davas\u0131 denmektedir.
